Staff Recommendation:
The hardship cited by the applicant is the fact that this
lot is approximately one-half as wide as the Zoning
Ordinance now requires for commercial lots. This is a legal
lot and the applicant considers the present setback
requirements to be excessively restrictive, severely
diminishing the use of the lot.
Staff estimates that once setbacks are removed from the
area of this property, only 35 to 40 percent of the property
would be available for use. It seems clear that the
setbacks written into the Ordinance are indicative of the
fact that we now consider larger lots necessary to the
successful development of commercial businesses, just as the
lesser setbacks of the old Ordinance reflected smaller lot
developments.of several years ago.
The problem, of course, is the fact that many of the small
lots from the earlier times still exist and must be dealt
with under the new ordinance. The new Ordinance
Section 5-101E addresses this problem. The proposed use of
the property is an allowable use under "C-3" zoning and the
applicant states that this use is unbuildable because of
strict Ordinance setback requirements.
Staff recommends approval of the variance with the following
conditions:

1. That the existing canopy and pump island be
removed.
2. That a solid fence be erected to screen this
property on the south side.
3. That the final development be in accordance with
the layout shown in the accompanying sketch.
Board Action:
The applicant was present, and there were no objectors. The
applicant cited his concern for some of the Staff comments
relative to the conditions that should be placed, and
finally the Board moved to approve the variance with the
Staff recommendations, except that which requires the
existing canopy be removed. The motion was passed: 6 ayes,
0 noes and 1 absent.
