Bryan,
Thanks for taking the time to talk to me this afternoon. Per our conversation, attached is the map that
the City distributed showing their proposed zoning classifications for the extra territorial jurisdiction that
includes the area where Today’s Power is planning to build a solar array. As we discussed, the proposed
zoning classification would change from Agricultural and Industrial to Parks and Open Spaces.
My understanding is that the City had previously agreed that there would be no zoning or permitting
requirements for this project, but I am concerned that if the zoning classification is changed, there could
be future issues for Today’s Power.
It would be greatly appreciated if you could lend your voice to the mix and encourage that this area be
considered Industrial.
For your convenience, I’m attaching the City’s proposed future land use map amendments, with the
area at issue circled in red. Additionally, I’ve included the Exhibit A from the joint easement from the
Port Authority and the City of LR showing the easement area in more detail.
One more question for you—are you familiar with the Corps of Engineers’ stance on wetland permits in
that area? Once the access easement moves onto the City of LR and Today’s Power properties, the
proposed access road is very close to the border of the wetlands. I’m going to reach out directly to the
Little Rock division office about it, but any insight you can provide regarding the usual SOP in that
scenario would be greatly appreciated.
