The applicant has not paid the filing fee on these
applications. Because of time constraints, staff normally
pursues its action on zoning cases prior to receiving notice
from the City Collector that all fees have been paid.
In effect, we assume good faith on the part of the
applicant, and this is the first time that this faith has
been in error in at least two years.
Because legal advertising has been published for these
cases, the planning Commission is obligated to deal with the
applications in some fashion. Staff is of the opinion that
the applicant did not pay the fees, so that some reading of
staff recommendation could be gained prior to the
expenditure of any money, thereby eliminating any "risk"
from his request.
STAFF RECOMMENDATION:
Since the applicant is apparently not prepared to follow
established procedure with his applications, staff
recommends that these applications be withdrawn from the
Agenda, and further that no special consideration be given
for the purpose of permitting a later filing prior to
expiration of the required twelve month waiting period.
COMMISSION ACTION:
The Commission moved to withdraw the applications. The
motion passed - 8 ayes, 0 noes and 0 absent.
