The applicant plans to develop condominium dwellings on
this property.
2. COMPATIBILITY WITH MUNICIPAL PLANS
Plans covering this area and past Board policy have
designated this land for residential use. The proposal
seems compatible.
3. EFFECT ON ENVIRONS
No adverse environmental impacts are expected.
4. NEIGHBORHOOD COMMENTS
No neighborhood position has been established; however,
some opposition is anticipated.
5. PUBLIC SERVICES/EFFECT ON
No adverse comments have been received.
6. UTILITIES/EFFECT ON
No adverse comments have been received.
7. EFFECT ON PUBLIC FINANCES
No adverse fiscal impact is expected.
8. LEGAL CONSIDERATIONS/REASONABLENESS
The proposed zoning seems to be of low enough density
to promote the intended development pattern established
for this area.

9. STANDARDS OF QUALITY
No standards of quality have been addressed.
10. TRAFFIC AND STREET RIGHT-OF-WAY
No traffic or right-of-way issues attend this case.
The street (Rainwood Road) will be constructed at the
time of development to proper standard.
ANALYSIS
The development expectation for this tract of land has been
for low density multifamily residential use. The proposed
development meets this criteria easily. A further bonus is
derived from the fact that this development will result in
"owned" rather than "rented" dwellings under a condominium
arrangement.
STAFF RECOMMENDATION:
Staff recommends approval.
COMMISSION ACTION:
The applicant was present and made no opening statement. An
objector, Sherrie Clawitter, spoke in opposition to the
zoning requested and offered a petition from nine
neighboring residents, who stated their concerns about the
higher density development and the perceived traffic
problems associated with the development._ She stated,
further, that they were concerned because they were not
fully aware of what was planned. Boyd Bond, the applicant,
stated that at the time the mailed notices were sent to
neighboring property owners as required by the Planning
Commission Bylaws, that those notified were offered an
opportunity to review the plans and that he had received
only two calls from any of those notified. The Commission
moved to defer consideration of the matter to January 29.
The motion passed: 5 ayes, 4 noes, 1 absent and 1
abstention (Robert Wright abstained). Subsequent to the
motion to defer, the Planning Commission stated that it
wished to see the site plan that Mr. Bond had offered to
the neighboring property owners, and he agreed to bring the
site plan to the Commission later in the meeting.
A short time later in the meeting, Mr. Bond returned to the
meeting with a copy of the site plan proposed for
development of this property. The Commission took a few
minutes to review the site plan and subsequently the
Commission moved to expunge the previous motion. The motion
to expunge the record passed: 9 ayes, 0 noes and 2 absent.
The Commission then moved to approve the zoning requested.
