The applicant states a desire to construct a new office
and warehouse for his business.
2. COMPATIBILITY WITH MUNICIPAL PLANS
No particular plan covers the area, but the existing
zoning and land use patterns in the area indicate
certain compatibilities.
3. EFFECT ON ENVIRONS
No adverse impact is anticipated.
4. NEIGHBORHOOD POSITION
No neighborhood comments have been received.
5. PUBLIC SERVICES/EFFECT ON
No adverse comments have been received.
6. UTILITIES/EFFECT ON
No adverse comments have been received.
7. EFFECT ON PUBLIC FINANCES
No particular fiscal impact is expected.
8. LEGAL CONSIDERATIONS/REASONABLENESS
The property abuts a significant "K" Zoning District on
the west. If anything appears out of place, it is the
small residential pocket which is surrounded on three
sides by industrial zoning and land use.
9. STANDARDS OF QUALITY
No standards of quality have been addressed by the
applicant.

No traffic or street right-of-way issues attend this
case.
ANALYSIS
In this instance, staff feels that periaps the out of place
element in this area of the City is the pocket of
residential left in the middle of a significantly
nonresidential development. While the residential uses
appear to be fairly stable at this time, there is no reason
to expect this to hold over a long haul. It is apparent
that the next logical eastern boundary of the industrial
district may be Boundless Street north from 12th Street.
STAFF RECOMMENDATION:
The staff recommends approval.

COMMISSION ACTION:
The applicant was present and stated his intention to
develop a 5000 square foot office warehouse complex for his
business. Several objectors were present, represented by
Bennie O'Neil. He presented petitions from the neighboring
property owners objecting to the request, and after a
lengthy discussion, the Commission moved to approve the
request as filed. The motion failed - 0 ayes, 7 noes, and 4
absent. There was no substitute motion, and the petition was
declared to have been denied.
