Zoning Ordinance and Subdivision Regulation. FACTUAL INFORMATION September 25, 1979 Item 4 1. NEED AND/OR DEMAND The applicant has filed a plat indicating plans to develop an 80 unit multifamily project. In effect, this request merely clarifies the zoning in this area by downzoning a parcel from "E -1-A" to "MF -24" in order to bring the entire parcel into continuity with neighboring parcels. 2. COMPATIBILITY The request is compatible with existing plans and existing development within the area. 3. EFFECT ON ENVIRONS No adverse impacts are expected. 4. NEIGHBORHOOD POSITION No adverse neighborhood position has been brought to the attention of Staff. 5. PUBLIC SERVICES/EFFECT ON No adverse comments have been received. 6. UTILITIES/EFFECT ON No adverse comments have been received. 7. EFFECT ON PUBLIC FINANCES Some enhancement of the tax base can be expected. 8. LEGAL CONSIDERATIONS/REASONABLENESS The zoning requested will permit no development which could not be accomplished under the existing zoning on the property. A development proposal now under review indicates a number of units well below the density permitted in the requested zoning district. 9. STANDARDS OF QUALITY No standards of quality have been addressed by the applicant. September 25, 1979 Item No. 4 - Continued 10. TRAFFIC AND STREET RIGHT-OF-WAY CONSIDERATION No right-of-way issues attend this case. However, traffic considerations may prove important. As presently planned, Brookside Drive would be an arterial street fronting along this property. There is, however, a movement afoot to abandon the proposed improvement of Brookside between Markham Street and Reservoir Road, which if approved, may have significant ramifications for the future development potential of this area. ANALYSIS: The requested zoning change will serve to clarify the zoning map and will have no significant effect upon the development of this area. STAFF RECOMMENDATION Staff recommends approval. COMMISSION ACTION: The applicant was present and there were no objectors. After a brief discussion, the Commission moved to approve the application as filed. The motion passed: 6 ayes, 0 noes and 5 absent.
