NEED AND/OR DEMAND The applicant has stated the intention to construct an unspecified commercial business at this location. 2. COMPATIBILITY WITH MUNICIPAL PLANS A long-standing community plan and a newer CDBG plan for this area call for the commercial development to be contained in the area now zoned for commercial use and near the intersection of Barrow Road and 36th Street. A commercial zone on the northeast corner of Barrow and 33rd was placed there in opposition to the long-standing plan. 3. EFFECT ON ENVIRONS Since the development proposed is unspecified, staff was unable to evaluate environmental impacts to be anticipated. 4. NEIGHBORHOOD POSITION The John Barrow CDBG Committee has formally expressed opposition to the request. 5. PUBLIC SERVICES/EFFECT ON No particular adverse impact is expected. 6. UTILITIES/EFFECT ON No adverse comments have been received. 7. EFFECT ON PUBLIC FINANCES No adverse fiscal impact is anticipated. 8. LEGAL CONSIDERATIONS/REASONABLENESS The property immediately north of this property is Zoned "C-3" and developed in that manner. The area around 36th Street, which has for a long time been zoned for commercial use, remains mostly vacant. The remaining area around this property is zoned "R-3" Single Family. � r i February 26, 1980 Item 2A - Continued 9. STANDARDS OF QUALITY No standards of quality have been addressed. 10. TRAFFIC AND STREET RIGHT-OF-WAY Barrow Road is planned as a major arterial to be widened to four lanes. The right-of-way will be required from the owner on both Barrow and 33rd Street. He has agreed to provide the needed dedication easement. There is a site distance problem for traffic trying to enter Barrow Road from 33rd Street, which must be considered with this application. ANALYSIS Repeated meetings between the applicant and the John Barrow CDBG Neighborhood Committee have resulted in no change from the original committee position which was to recommend that this application be denied. STAFF RECOMMENDATION: Staff recommends denial. COMMISSION ACTION: The Commission suggested, because of the many deferrals, that they would prefer to send the application to the Board without a recommendation. However, it was pointed out that this probably would not be a suitable solution if any other solution were possible. The Commission members then present voted unanimously to suspend the procedural requirements of the bylaws wherein they would have to provide six votes to deny the application. They then, after a lengthy discussion relative to the merits of the case, made a motion to approve the application as filed. The motion failed on a vote of 2 ayes, 4 noes and 5 absent, and it was declared to have been denied so that it could be appealed to the Board of Directors.
