Approval of the Minutes of the Previous Meeting September 17, 1979 Item No. 1 - Z-3393 Owner: Cornelia Terry Thomas Address: 4 Longfellow Lane Description: Lot 1, Cornelia Thomas Subdivision Zoned: "A" One Family Variance: Request variance from Section 43-12 (J) to permit a wall in excess of 6' in he ight . Present Use of Property: Single Family Proposed Use of Property: Single Family STAFF RECOMMENDATION: The wall in question is already in place and has been for some time. The wall is part of a larger landscaping plan which has been carried out. Staff finds no pressing reason for requiring either its removal or its shortening. Staff recommends approval of the height as presently constructed. September 17, 1979 Item No. 2 - Z-3394 Owner: Address: Description: Leroy Hamaker Route 5, Box 442BB Little Rock, AR 72212 Northwest Corner, Rummel Road at Mooser Lane Zoned: "A" One Family Variance: Request variance from Section 43-3 (7) to permit location of an accessory building nearer to the front property line than 601. Present Use of Property: Proposed Use of Property: Single Family Single Family STAFF RECOMMENDATION: The issue here is the location of an accessory structure. The existing mobile home residence of the applicant is a legitimately constituted nonconforming structure. The applicant has stated that the second mobile home was purchased for use as storage and workshop space clearly as an accessory to the principle structure. The hardship associated with the requested location of the accessory structure deals with periodic flooding and general wetness in the normal area of the rear yard designated for accessory structures. Staff recommends approval of the request with the condition that the kitchen and bath facilities be dismantled to preclude possible dwelling use of the accessory structure. Present Use of Property: Proposed Use of Property: Single Family Day -Care Center STAFF RECOMMENDATION: The request will allow conversion of an existing single family structure on two lots to use as a day-care facility. Malloy Street has been upgraded to City standards under the Community Development program. 36th Street is an arterial on the Master Street Plan. On-site inspection reveals reasonable access to the property and an adequate lot size for the proposed use. Present Use of Property: Church Proposed Use of Property: Church STAFF RECOMMENDATION: The First Pentecostal Church has suffered losses in excess of $4,000 due to theft and vandalism over the past several months. Installation of an alarm system has curtailed some of the loss. However, several recent problems have indicated that stronger steps must be taken. The requested permit will allow location of a mobile home to provide a residence for a full-time security person. Staff recommends approval. September 17, 1979 Item No. 5 - Z-3401 Owner: Retail Clerks Union, Local 1553 By: Ralph Green Address: 1201 Bishop Street Description: Lots 1, 2, 3 and the North 12' of Lot 4, Block 2, Centennial Addition Zoned: "E--1" Quiet Business Variance: Request variance from Section 43-14 (2) to permit a 51 encroachment into a required rear yard. Present Use of Property: Office Proposed Use of Property: Office STAFF RECOMMENDATION: The requested variance will permit an addition to an existing structure. The only side of the structure suitable for addition is the east side. The addition will replace a small parking area in the rear of the building. No harm to the spirit of the ordinance will come from this request. Staff recommends approval of the 5' encroachment. September 17, 1979 Item No. 6 - Z-3388 Owner: Lieselotte Carms Sebastian By: Ralph Green Address: 3809 Plateau Description: The West 55.71 of Lots 1 and 2, Block 7, Plateau Addition Zoned: "B" Residence variance: Request variance from Section 43-12 to permit an encroachment into a required side yard. Present Use of Property: Proposed Use of Property: Single Family Single Family STAFF RECOMMENDATION: The requested variance will permit addition of a utility room for installation of a washer and dryer on the first floor. The applicant states that a medical disability requires this request. Because of the alley, there will be no encroachment upon the neighboring properties. Approval of the Minutes of the Previous Meeting August 20, 1979 Item No. 1 - Z -3365-A Owner: Don and Mary Scott Address: 422 Martin Street Description: Lot 6, Block 6, C.H. Taylor Addition Zoned: "C" Two Family Variance: Request variance from Section 43-12 to permit encroachment into a required yard. Present Use of Property: Single Family Residential Proposed Use of Property: Two Family Residential STAFF RECOMMENDATION: This property was recently the subject of a rezoning action to permit the construction of the proposed duplex. Staff supported the zoning action with the knowledge that the requested variance would be required. Staff recommends approval of the required variance calling for a 15 foot rear yard reduction and a three foot side yard reduction. r August 20, 1979 Item No. 2 - Z-3387 Owner: Address: Description: Bob Thomas 7323 Indiana Street Lots 11 and 12, Block 6, Forest Park Highlands Zoned: "C" Two Family Variance: Request variance from Section 43-21-(J) to permit a wall in excess of the permitted height. Present Use of Property: Duplex (under construction) Proposed Use of Property: Duplex STAFF RECOMMENDATION: At issue here is a retaining wall located on the north and east property lines of this parcel. The wall is designed to permit leveling of the yard abutting Indiana Street. However, the wall as constructed produces a difficult sight problem for vehicles attempting to leave the driveway just east of the wall on a neighboring property. The only solution staff sees for resolving the sight problem while allowing for the leveling work intended by the applicant is to change the configuration of the wall to angle across the corner at something approaching 451 from the proposed driveway and the wall as it extends along the east property line thereby creating a setback of the east wall of some 12 to 15 feet. Staff recommends that this course of action be followed. August 20, 1979 Item No. 3 - Z-3379 Owner: Jack and JoAnn Files Address: 916-924 Commerce Street Description: Lots 7, 8 and 9, Block 59 Original City Zoned: "HR" High Density Residential Variance: Request permission under the provisions of Section 43-35 (2) to establish a professional office in the "HR" District. Present Use of Property: Apartments Proposed Use of Property: Professional Office/Apartments STAFF RECOMMENDATION: The applicant proposes to establish a professional office on the first floor of the structure and retain the apartment uses with the remainder of the building. The only problem staff sees in the request is one common to this entire of the City, and that is parking. There seems to be a shortage of adequate parking facilities, and staff feels this issue must be addressed in conjunction with the conditional use permit. Staff would not be opposed to a limited waiver of some of the required parking for this particular site. Staff recommends approval of the conditional use permit conditioned upon resolution of the parking issue. August 20, 1979 Item No. 4 - Z-3389 Owner: Address: Description: Zoned: Variance: Present Use of Property: Proposed Use of Property: James Rose By: Marleen Palmer 2321 Vancouver Drive Lot 1, Block 4, Phase I, Parkwood Addition "A" One Family Request permission under the provisions of Section 43-22 (4) (d) to permit establishment of a day-care facility in a residential district. Residential/Baby-sitting Service Day -Care Center STAFF RECOMMENDATION: On the premises, there is an existing day-care type facility. The requested variance would permit the addition of several children to the existing service. No particular physical changes in the property are anticipated. The proposed use is, in the staff's opinion, not compatible with the surrounding land uses, all of which are single family residential. Also, the requested use would be a direct violation of the Parkwood Addition Bill of Assurances.
