13 WHEREAS, Ordinance No. 20,696 was passed on February 19, 2013, establishing a PZb 1W4da
14 Zoning District titled Interstate 430 Shoppers Mall Long -Form PCD (Z -3371 -TT), located at 119g0��0
15 Glenn Road; and

16 WHEREAS, the automobile sales and automobile collision repair approved for Interstate 430 Shop�brsi lim'%
17 Mall Long -Form PCD (Z -3371 -TT), located at 11900 Colonel Glenn Road, is no longer a viable project
18 since Baptist School of Nursing elected to maintain this location as their school campus and the owner of
19 the subject property has requested the repeal of the PZD ordinance and restoration of the zoning
20 classification as previously existed; and
21 WHEREAS, the Baptist School of Nursing has modified their degree program and is now considered
22 a college or university which is not an allowable use within the underlying C-2, Shopping Center District,
23 zoning classification; and
24 WHEREAS, Baptist School of Nursing is requesting a rezoning of the property from C-2, Shopping
25 Center District, to C-3, General Commercial District; and
26 WHEREAS, the Little Rock Planning Commission reviewed the requests for revocation and rezoning
27 at their July 16, 2015, public hearing and voted 11 ayes, 0 nays and 0 absent to forward the revocation and
28 rezoning requests to the Little Rock Board of Directors for final action.
29 NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
30 OF LITTLE ROCK, ARKANSAS.
31 SECTION 1. That Ordinance Number 20,696 is hereby repealed, removing from the official zoning
32 map the classification PCD.

2 the property described as:
3 Lot 1, Interstate 430 Shoppers Mall Addition, Little Rock, Arkansas, containing 12.91
4 acres AND Lands located in the southwest'/ of Section 16, T -1-N, R -13-W, City of
5 Little Rock, Pulaski County, Arkansas more particularly described as follows:
6 Commencing at the southeast corner of the southwest '/4 of the southeast '/4 of the
7 southwest '/4 of said Section 16, which is also the point of beginning; thence
8 N88°5'22"W, 611.95 feet to a point which is also on the east right-of-way of Bowman

32 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
33 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
34 ordinance.

SYNOPSIS
Baptist School of Nursing is requesting a revocation of a
previously approved PCD and a rezoning of the property
from the underlying C-2, Shopping Center District zoning
to C-3, General Commercial District.
FISCAL IMPACT
None.
RECOMMENDATION
Staff recommends approval of the revocation and rezoning
requests. The Planning Commission voted to recommend
approval of the revocation and rezoning requests by a vote
of 11 ayes, 0 noes and 0 absent.
CITIZEN
The Planning Commission reviewed the proposed PCD
PARTICIPATION
revocation and rezoning requests at its July 16, 2015,
meeting and there were no registered objectors present. All
property owners located within 200 -feet of the site along
with the John Barrow Neighborhood Association were
notified of the Public Hearing.
BACKGROUND
The Planning Commission reviewed a request to rezone the
site from C-3, General Commercial District and C-2,
Shopping Center District to PCD and allow the creation of a
preliminary plat at their January 24, 2013, public hearing.
The preliminary plat included two (2) lots. Lot IR was
proposed for automobile sales and service and automobile
collision repair and Lot 2 was proposed for inventory storage
and future C-2, Shopping Center District uses. The Little
Rock Board of Directors approved this request by the
adoption of Ordinance No. 20,696 on February 19, 2013.
At the time of approval Baptist School of Nursing was to
move to a new site along Cantrell Road. This move did not
occur thus the site was not redeveloped with the automobile
related activities.
Baptist School of Nursing has changed their educational
format and is now offering credits to receive college degrees.
The C-2, Shopping Center District designation allows for a
Business or trade school but the designation does not allow
for a college. The applicant's request is to revoke the PCD
zoning and restore the previously held C-2, Shopping Center
District and C-3, General Commercial District zoning
designations. In addition the applicant is requesting to
rezone the C-2, Shopping Center District portion of the site
to C-3, General Commercial District to allow Baptist Health
College to be in compliance with the zoning classification.
Staff is supportive of the revocation request as well as the
rezoning request. Staff views the request reasonable. The
proposed C-3, General Commercial zoning is consistent
with the City's Future Land Use Plan designation and does
not require a change to the Land Use Plan. The college and
associated parking currently occupy the property. Staff feels
the rezoning of the site to C-3, General Commercial District
is appropriate.

application we are also requesting that the prior PCD zoning action be rescinded. The following
items are included for your reference in this application:
1. Six copies of the most current boundary survey.
2. Completed rezoning application.
3. A copy of the Planning Commission minutes for the prior zoning to PCD.
4. A copy of the Board of Directors ordinance approving the prior zoning to PCD.
5. A copy of the Bill of Assurance for Lot 1, 1-430 Shopper's Mall Addition.
6. Our check for $445.00 to cover the filing fees.
As you are aware, this application is being submitted to accomplish two specific items. First: to
bring the property into zoning compliance for the use as a college. Second: to allow construction
