3 AN ORDINANCE TO DECLARE IT IMPRACTICAL AND UNFEASIBLE
4 TO BID; TO AUTHORIZE THE CITY MANAGER TO ENTER INTO A
5 SOLE-SOURCE CONTRACT WITH MB PAVEMENT MARKING
6 EQUIPMENT DIVISION, IN AN AMOUNT NOT TO EXCEED NINETY
7 ONE THOUSAND TWO HUNDRED NINETEEN AND 93/100 DOLLARS
8 ($93,219.93), PLUS APPLICABLE TAXES AND FEES, FOR THE REPAIR
9 OF ONE (1) PACCAR PETERBILT LINE STRIPING TRUCK FOR THE
10 PUBLIC WORKS DEPARTMENT CONTROL DEVICES DIVISION; TO
11 DECLARE AND EMERGENCY; AND FOR OTHER PURPOSES.

13 WHEREAS, there is a need to repair of one (1) Paccar Peterbilt Line Striping Truck for the Public
14 Works Department Control Devices Division; and,
15 WHEREAS,Unit 16J246 sustained extensive damage when the entire air system was contaminated by
16 paint;and,
17 WHEREAS,MB Pavement Marking Equipment Division is the sole-service provider to repair the only
18 truck in the fleet to line stripes for Little Rock Street Maintenance which meets Departmental
19 Specifications;and,
20 WHEREAS, the total cost of this purchase is Ninety-One Thousand. Two Hundred Nineteen and
21 93/100 Dollars($91,219.93),plus applicable taxes and fees,and an additional 25%contingency of Twenty
22 Two-Thousand, Eight Hundred Four and 98/100 Dollars ($22,804.98), set aside in the event of continued
23 ice increases.
24 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
25 OF LITTLE ROCK,ARKANSAS:
26 Section 1. The Board of Directors hereby authorize the City Manager enter into a contract with MB
27 Pavement Marking Equipment Division for the repair of one(1)Paccar Peterbilt Line Striping Truck,with
28 an estimated cost of Ninety-One Thousand,Two Hundred Nineteen and 93/100 Dollars($91,219.93),plus
29 applicable taxes and fees, and an additional 25% contingency of Twenty-Two Thousand, Eight Hundred
30 Four and 98/100 Dollars($22,804.98)set aside in the event of continued price increases.
31 Section 2.Funds for this purchase are allocated in the Fleet Maintenance Account No. 600031-63375.
32 Section 3. Because MB Pavement Marking Equipment Division is the only repair and service provider
33 in the area, meeting the requested specifications, the Board of Directors declares it is impractical and
34 unfeasible to submit this purchase to competitive bids.

1 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
2 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
3 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
4 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
5 ordinance.
6 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same,that are inconsistent with
7 the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
8 Section 6. Emergency Clause. The ability to have Public Works Control Division's, Unit 16J246,
9 which is the only truck in the fleet that can provide the line stripes to maintain the streets of Little Rock
10 repaired and serviced is essential to the public health, safety and welfare; an emergency is, therefore,
11 declared to exist and this ordinance shall be in full force and effect from and after the date of its passage.
