HomeMy WebLinkAboutBill of AssuranceName: Perry Norwood ) Joann Norwood ) BOA33.0 PAGE 81 BILL OF ASSURANCE TO THE PUBLIC ) WHEREAS, Perry Norwood and Joann Norwood, are the sole Owners of the following property: A tract of land in the N'z, NIY4, Section 31, T-1-N, R-12-W, Pulaski County, Arkansas,.more particularly described as follows: Starting at the SW corner of said Ni, NW'a, run thence East 30.0' to the East R/IY line of Geyer Springs Road; run thence North along said East R/IV 797.0' to'the point of beginning, being also the NW'c'orner­of Soutlipaik Subdivision; thence continue along said East R/IV N 00 051 IV 158.61; thence S 890 39' E 673.01; thence S 00 28' IV 159.4'' to the NE corner of Southpart Subdivision; thence N 890 35' W along the North line of Southpark Subdivision 671.5' to point of beginning, containing 2.45•acres. THAT IVE, Perry Norwood and Joann.Norwood hereinafter termed grantors, have caused said tract of land to -be surveyed•by Mehlburger Engineers, Inc., Registered Professional Engineers and a plat thereof made which is identified by the title NORWOOD SUBDIVISION.and the date March 7, 1975 and by the signature of the said Engineer and the said Grantors, and bears a Certificate of Approval executed by the Little Rock'Planning Commission, and is of record in the office of the Circuit Clerk and ex-officio Recorder of Pulaski County, Arkansas, in Plat Book S Page, and the grantors do hereby make this Bill of Assurance. The grantors do hereby certify that. they have platted said real estate in accordance with said plat. The lands embraced in said plat shall be.forever known as designated on said plat; and every deed of conveyance for said property shall use this designation. The filing of the Bill of Assurance and plat for record in the office of the Circuit Clerk and ex-officio Recorder of Pulaski County shall be a valid and complete delivery and dedication of the.streets and easements shown on the said plat. All buildings constructed on said lots shall -be constructed no nearer to the street than the building line shown.on the plat and all buildings shall be constructed in conformance with the Building Code and Zoning Ordinance of the City of Little Rock, Arkansas. There are strips of ground shown and dimensioned on said plat each marked "Utility and Drainage Easement" reserved for the use of public utilities and for _.V1 - gpl.330 PAGE 82 drainage purposes; -subject at all times to the proper authorities and to the easement herein reserved. These covenants and restrictions are to run with the land and shall be binding on all parties and all persons claiming under -them for a period of 30 years from the -date these covenants and restrictions are recorded-, after which time said covenants'and'restrictions shall be automatically extended for successive periods of 10 years, unless an instrument signed.by the then Owners of•the lots has been recorded, agreeing to change said covenants and restrictions in whole or in part. These covenants and restrictions.shall not be amended, cancelled or - supplemented unless an instrument signed by the Owners of the aforesaid lots is placed of record agreeing to -change the covenants and restrictions in whole or in part and any change must be approved by the Little Rock Planning Commission. The invalidation of any one of these covenants or restrictions by judgement or court order shall in no wise affect any of the other provisions, which shall remain in full force and effect.
