11:30 a.m. in the Sister Cities Conference Room on the second floor of City Hall. Chair Tim
Heiple called the meeting to order.

OPEN PUBLIC MEETING:

Bob Brown began the meeting regarding the landscape variance request located at 12,001
Interstate 30. Currently, the site is wooded. The applicant is proposing to develop an
office/warehouse and associated parking areas on this industrial zoned property. The adjacent
properties are also zoned industrial with the exception of a portion of the adjacent property to the
east, which is zoned for commercial use.
Both landscape and zoning ordinances require a minimum thirty-foot wide on -site landscape
buffer where adjacent to a freeway or expressway. The applicant proposes a landscape buffer
varying in width from twenty-one feet to fifty feet.
Since the Zoning Ordinance also requires a minimum thirty-foot wide on -site buffer where
adjacent to freeways and expressways, the applicant is seeking a width reduction variance by the
Board of Adjustment. This item is scheduled to be presented at their May 23`d hearing. The
applicant contends that the proposed location of the structure and associated parking is limited by
f the existing billboard and wedge shape of the site.

Recently, on -site trees along Otter Creek South Road and Interstate 30 have recently been
- from the Public Works Department. The clearing was
removed prior to receiving approval
performed by Boyle Construction Company, hired by the seller of the property to Lamar
Advertising. Boyle is installing utilities and widening Otter Creek South Road. Since the trees
were removed without a grading permit, Boyle was issued a citation to appear in court by the
Public Works Department. A grading permit has since been issued for only the previous work.
Applicant noted the removal of the trees was due to the installation of pipes and capital
improvements for the area. Also, some trees were recently removed for the placement of a
billboard on the property. Applicant noted they were willing to replant the area and berm along
I-30; although they felt the gradient change on the property would impact the amount of
screening to be accomplished.
Motion: Karol Zoeller made a motion to grant the variance request with two conditions.
Screening along Interstate 30 to be accomplished at a minimum height of 30". This
screening is to consist of a combination berm and additional trees. Secondly, 160 feet of
forested area along southern perimeter of the property, is to remain undisturbed.
Second: Lynn Warren seconded the motion and it passed with one nay and 8 ayes.
Motion: Lynn made a motion for the minutes to reflect that this variance request approval does
not, in any form, condone the cutting of the trees.
Second: Motion was seconded by Karol Zoeller and passed unanimously.
LAND ALTERATION ORDINANCE REVISIONS:
Clear cutting definition is ok as is
Jan Hicks commented, "no changes should inhibit economic development in the City of Little
Rock. This past Sundays paper stated that currently, development is slow in Little Rock."
29-170. (b.) Leave as is defined in 170 (h).
29-170. (d.) would recommend attaching a number for the verbiage imminent; such as 30 days
following land alteration activities.
29-170. (i.) would recommend a definition defining "responsible party" as whoever obtains
permit for work to be done or the owner.
29-172. (d.) CBC feels that the Board of Directors should be an appellate to decisions made by
the Planning Commission.
29-184. (d.) Dottie Funk recommends that the definition of letter (d.) needs to change to,
"individual trees to be preserved outside the protected area shall be fenced at no less than 75% of
the area within the drip line of the critical root zone."
29-186. (d)(3)(iii.) CBC agrees with Pete Rausch's comments; however, feels it is not practical
right now.
29-186. (b.) add the verbiage "Chapter 36, the zoning ordinance" to the sentence.

APPROVAL OF THE MINUTES:
Motion: Troy Laha moved to approve the minutes from the February 3`a, meeting
revising the attendees of the meeting, noted.
Second: Karol Zoeller seconded the motion and it passed unanimously.

Motion: John Beneke made a motion to continue the discussion regarding the proposed land
alteration ordinance changes in one week from today at the same place, same time.
Second: Lynn Warren seconded the motion and it passed unanimously.
