The City Beautiful Commission held its regular meeting Thursday, March the 3rd 2005, at
11:30 a.m. in the Sister Cities Conference Room on the second floor of City Hall. Chair Tim
Heiple called the meeting to order.

OPEN PUBLIC MEETING:
Mike Hood began the meeting with a PowerPoint presentation and accompanying handouts to
The CBC regarding the proposed revisions to the cities Land Alteration Ordinance. The public
Works department has taken recommendations and will be presenting the proposed changes to
the board of directors. Below are some of the issues presented thus far:
• Define terms such as "restore to the maximum extent practicable" and "imminent
construction:
• Existing appeal process delays resolution by 90 days;
• Appeal process is cumbersome;
■ Administrative appeal process must be exhausted prior to appearing in Environmental
Court;
• Better define the role of the planning commission, what do they rule on;
• Re-evaluate remedial or corrective action;
• Improve understanding and readability;

Planning Commission had the following recommendations to add:
Forestry management plans should be. prepared by a registered forester and approved by
staff including zoning, public works, and urban forester;
• Variances can only be considered for approval prior to issuance of a notice of violation;
• Filling activities that involves some clearing should be reviewed and permitted by staff
on single lots or single tracts of lands without imminent construction with terms and
conditions such as required buffers, erosion controls, establish vegetation, replant trees;
Also noted by staff was the increase in the grading permit fees as follows:
■ Grading permit fees are based on the amount of proposed disturbed area of each
construction project;
• Current fees are $100.00 per acre of disturbed area up to a maximum of $550.00;
• Proposed fees are $120 per acre of disturbed area up to a maximum of $660.
Dottie Funk, concerned citizen, mentioned the hard work put forth from the task force
previously. Also, she felt that all interested parties had not been advised of the intent to make
changes. Public works noted that it was discussed at a public meeting and the revisions proposed
are minimal. Staff feels like the ordinance is working and merely needs some minor adjustments
and clarifications.
The CBC discussed the proposed changes briefly and decided to vote at next months regularly
scheduled CBC meeting. The CBC will get the motion/discussion to the public works
department prior to their presentation in April.

The CBC would like to welcome the newest CBC member to the group, Jan Hicks.
Jan Hicks spoke with David Hathcock and 84 blocks have been adopted since January of 2005.
Motion: Lynn Warren made a motion to buy 6 pinchers to help with the litter clean up on
Bowman Road.

Stacy Croom, with the UALR law school, noted that each law student must annually volunteer
for a non-profit organization to graduate. Perhaps, the law school could help out in some of the
CBC programs. For further information, contact the assistant dean of the law school.
Jack Singleton -Keep Arkansas Beautiful
Support recommended for an up coming bill, the Clean Water Act. Also, CBC might want to
consider having someone from the water department or storm water management on the task
force for Keep Arkansas Beautiful. Jack handed out the important dates and target deadlines for
the progress of the task force and its missions.
Lynn Warren -Spring Landscape Awards
Lynn brought examples of each of the award(s) and the prices for each. Her recommendations
were presented and it was decided to do an email vote on the recipients recommended, the types,
and the number to be given.
Motion: Karol Zoeller made a motion to give the various awards and certificates to the chosen
award winners at the mid -May board meeting.
Second: Lynn Warren seconded the motion and it passed unanimously.
Also noted: there is an open water stop at this Sunday's race.
