HomeMy WebLinkAbout15756 1 RESOLUTION NO. 15,756 2 3 _ TO EXPRESS THE WILLINGNESS OF THE CITY OF LITTLE ROCK, 4 ARKANSAS, TO PARTNER WITH THE ARKANSAS DEPARTMENT 5 OF TRANSPORTATION FOR THE TRANSFER OF THE 6 CUMBERLAND STREET RIGHT-OF-WAY, SOUTH OF PRESIDENT 7 CLINTON AVENUE; AND FOR OTHER PURPOSES. 8 9 WHEREAS, the City of Little Rock, Arkansas, (City) has a history of partnering with the Arkansas 10 Depart ent of Transportation (ArDOT) to improve mobility and accessibility in downtown Little Rock; 11 and, 12 W.1 REAS, the City has requested ownership and maintenance responsibility of the portion of 13 Highw.‘ 10(Cumberland Street), south of President Clinton Avenue as indicated in Exhibit A; and, 14 W EREAS,ArDOT has agreed to transfer the ownership and maintenance responsibility for a portion 15 of High ay 10(Cumberland Street)to the City. 16 N I W THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF LITTLE ROCK, 17 ARKA SAS THAT: 18 Sec ion 1. The City will participate in accordance with its designated responsibilities in this project 19 as desc 'bed in the agreements to transfer ownership of the right-of-way. 20 Sec ion 2. The Mayor or City Manager or their designated representatives are hereby authorized and 21 directe a to execute all appropriate agreements and contracts necessary to expedite the transfer of the portion 22 of High ay 10(Cumberland Street)from President Clinton Avenue, south to 3rd Street. 23 Sec 'on 3. The City pledges its full support and hereby requests that the Arkansas Department of 24 Transportation initiate action to transfer the portion of Highway 10 (Cumberland Street). 25 Section 4. The Board of Directors pledges its full support and hereby authorizes the Arkansas 26 Department of Transportation and Metroplan to initiate action to implement this project. 27 Se tion 5. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 28 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 29 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 30 effect a if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 31 resoluti n. 32 Se ion 6. Repealer.All laws,ordinances,resolutions,or parts of the same,that are inconsistent with 33 the pro isions of this resolution,are hereby repealed to the extent of such inconsistency.
