MINUTES OF MEETING OF THE CITY PLANNING COMMISSION 11MD FRIDAY, NOVEMBER 24, 19449 AT 1:00 OvCLOCK IN THE COMMISSION OFFICES LITTLE ROCKO ARKANSAS The meeting was called to order by Chairman J. N. Heiskell, the following members being present: J. N. Heiskell Fred I. Brown DeMatt Henderson Louis Tarlowski Charles Davis S. V. Bracy Messrs. L. A. Henry and Edward G. Webster were also present. Chairman Heiskell read a zoning petition of R. M. Carter, owner of property located at 1700 Cumberland Street, described as Lot 12, Block 163, Original City of Little Rock, for reclassification of said property from present "C" Two-family District to that of "I" Light Industrial District, and for waiver of lot area requirements and for yard space requirements to permit erection of a one-story, hollow the structure on rear of lot to be used as a welding shop. A waiver of protest to this petition, having; 18 signatures was handed to the chairman by R. N. Carter before the meeting was called to order. After a full discussion, the petition was unanimously voted "disapproved". The following statement was agreed upon and attached to the petition: "Disapproved because this would be spot zoning and illegal under the zoning ordinance. We gear a welding shop in this location would create conditions that should not be permitted in a residence district". The matter of legality of spot zoning in general was discussed, Mr. Ta.rlowski stating that it has been held illegal in every court decision to his knowledge. -2- Mr. Webster was called upon by Mr. Heiakell to lead a discussion on procedure to be followed in revising the zoning ordinance. Mr. Webster told of Mr. S. Herbert Hare's visit Saturday, November 18, stating that he had familiarized Mr. .flare with the city and all available maps and other data that would assist him in estimating cost figures for his professional services. Mr. henry then explained that a great deal of preliminary work should be done by the Planning Commission with information obtained from the State Highway Commission, b'ederal Public Roads Administration, and local groups such as the Real Estat® Board. He pointed out the importance of a definite plan of a major street system before any rezoning is attempted, and urg©d that a consultant be obtained only for writing the ordinance and outlining the district map. Mr. Webster explained the difficulty the Civil Service Commission is having in finding a draftsman for the Planning Commission because of the salary limitations. Mr. Henry asked Mr. Davis if the finance Committee of the City Council could not apply the unspent money of the draftsman's appropriation and raise the salary to an appropriate amount. Where- upon, Mr. Tarlowski presented a motion requesting the secretary to write a letter to the Chairman of the Finance Committee recommending that the draftsman's salary be raised from $1800 to $2400 per annum. The motion was voted upon and carried unanimously. Mr. Webster also told of his difficulty in getting typing done, but it was conceded that a draftsman would be a greater necessity than a stenographer. W3 Action on a preliminary subdivision plan "Rinke Garden Acres" loomed below Base Line Road and west of Hilaro Springs Road was deferred pending a decision from the County Planning Board.
