PLANNING COMMISSION HELD MONDAY,
AUGUST 28, 1944, AT 1:30 O'CLOCK
IN THE COMMISSION OFFICES
LITTLE ROCK, ARKANSAS
The meeting was called to order by Chairman J. N. Heiskell,
the follosing members being present:
Fred I. Drown
Sam Bracy.
Louis Tarlowski
J. N. Heiskell
Charles Davis
DeMatt Henderson
Roy Kumpe
Sidney L. Kahn
Mr. Edward 0. Webster, Engineer -Director, and Mr. L. A. Henry,
Consultant for the State Planning Commission, were also present.
Mr. Heiskell stated that Mr. Henry was present at his request,
said request including all future meetings, and Mr. henry cordially
agreed to meet with us whenever possible.
Mr. Heiskell stated that the first matter to be submitted to
the Commission was one which does not ordinarily require a zoning
petition,rightfully comes under either paragraph (7) or (8) of the
Powers and Duties of the Zoning Board of Adjustment, which Board is
no longer in existence.
Petition of Mr. J. V. Flack was then read, as follows: "The
property concerned is owned by Mr. J. V. Flack, and is located at 2309
W. 12th Street, Block 2,-Lot 3, Park Addition. This property is now
in a "C" Two-family'Distriot and hies on it a one -family duelling, a
one -car garage, and a two -cats garage. The owner wishes to be per-

witted to build a single family apartment over the two -oar garage
to provide a home for his feather, rent free. The building is on the
alley line, is beyond the required 60 foot minimum distance from the
front property line, but is presumablid closer than the required five
- 2 -
feet to the side property line." Mr. Webster stated that the
petitioner had agreed to move the garage,over which he seeks to
erect a single-family apartment, five feet from alley. Petition was

approved, provided improvement is moved five feet from alley'a
above noted.
Lula P. Ensor petitioned for reclassification of six lots on
the north side of Asher Avenue between Filson and Peyton Streets,
described as Lots 10, 11, 13, 14, 15 and 16, Block 3, Riffel &
Holder's Addition, from the present Commercial "F" District to that
of Heavy Industrial "K_" District property, for the following uses:
(1) Building; material Storage; (2) carting, express, hauling or
storage yard; (3) contractorts plant or storage yard; and (4) lumber
yard. Petition to reclassify as heavy Induatrial '1K" was denied,
but was approved for reclassification as Light Industrial "I" which,
in the opinion of the Commissioners, would grant petitioner all
rights she desires
Mrs. Henry Schuler (Mildred VanLaridingham) petitioned for
waiver of lot area requirements and yard spade requirements and
reclassification of property from the present "B" Residential Dis-
trict to that of "C" Two -Family District, and permit to use as a
one -family apartment an apartment garage, already erected, on
property located at 2103 South Cedar Street, described as Lots 11
and 12, Block 7, Neimeyer Addition to the City of Little Rock.
Building permit was issued with the understanding that budding was
to be a brooder house for poultry, which permit #5652A was revoked

by the Building Commissioner August 7y 1944. Petitioner states
that the rental from the building is required as an additional
source of revenue, as her husband is in the Armed Service.
Petition approved.
Sam Stewart, Sr., colored, petitioned for waiver of lot area
requirements and yard space requirements, and permit to build a
one-story, wood frame dwelling 31* feet by 46 feet including a
porch 6 feet wide running entire length, and set back from 27th
Street property line only one foot; building to occupy East one-
half of lot located at 2619 S. Spring Street, also 310 W. 27th
Street, described as Lot 13, Block 3, Deshons Addition to the City
of Little Rock. Petition -denied.
Mr. Heiskell then referred to letter of Mr. Webster dated
August 24`ch in which six matters were mentioned. Referring to
#1, it was unanimously agreed that the Zoning Hoard of Adjustment
should bo reconstituted by the proper authorities in accordance
with Ordinance #5420.
Re. #2. Mr. Heiskell read and :submitted a letter requesting
Mr. Henry's assistanpe and Mr. Henry, being present, indicated that
he would be pleased to comply as soon as possible.
Re. #3. It was unanimously decided that no further committees
should be organized or appointed, but that our Commission should
work in close collaboration with proper Chamber of Commerce
committee and the Little Rock Real Estate Commission.
Re. #4. Mr. Webster stated that he had, to the beat of his
ability in the inadequate tivie that has elapsed since he assumed

office, tentatively revamped a Zoning District Map, He particularly
stressed the probable desirability of rezoning for apartment
houses where they are already extant in a now single -residence
classification. Commissioner Kahn suggested that a revision of
the Zoning District Map could not be pr•ecipiti.ously accomplished.
It requires immeasurable study and analysis and should not be
hurried. It was then agreed that Mr. Vlebster inquire of Mr. Harlan
Bartholomew that work it would be prudent for him to prosecute and
whet data Mr. Bartholomew desired in order to revise our Zoning Map.
Particular emphasis was placed upon Mr. Webster's inquiring
probable fee Mr. Bartholomew would require to do thin work.
Ito #5 and ,#6. Messrs. 4;ebster and Kahn were requested to
personally investigate the two requests for Flat and Bill of
Assurance approval presented by Mr. D. E. Raines and Mr. 11. F.
Buhler and report at the next meeting.
The Commission unanimously agreed that Mr. Webster request
the City Council to re-enact the Set -back Ordinance , previously
enacted according to the Nolan Plan, said Ordinance being #5071.
Mr. Tarlowski suggested that future meetings of the Commission
be held at 4:15 P.M. in lieu of 1:50 P.M., but Mr. Heiskell stated
that he could meet at no time other than one or one -thirty. It
was agreed that future meetings be held at 1:00 P.M.
There being too further business, the meeting stood adjourned.
