3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO A CONTRACT WITH ACS PLAYGROUND ADVENTURES, IN AN
5 AMOUNT NOT TO EXCEED ONE HUNDRED TWENTY-ONE
6 THOUSAND, SEVEN HUNDRED FIFTY-ONE AND 85/100 DOLLARS
7 ($121,751.85), PLUS APPLICABLE TAXES AND FEES, FOR
8 CONSTRUCTION SERVICES FOR THE WESTERN HILLS PAVILION
9 PROJECT; AND FOR OTHER PURPOSES.

11 WHEREAS, Citizens in the Western Hills Neighborhood and the surrounding area have supported
12 this project for many years and are excited to see continued construction towards the completion of the
13 development of a neighborhood park; and,
14 WHEREAS, the Parks and Recreation Department requests a contract with ACS Playground
15 Adventures for Construction Services of a thirty (30)-foot x forty-four (44)-foot Poligon Pavilion for the
16 Western Hills Park;and,
17 WHEREAS,funds will be provided by the Western Hills Park 3/8-Cent Capital Improvement Sales
18 Tax Funds,Account No. 326459-TS45A20 and Legacy Grant Funds,Account No. 270459-G23147; and,
19 WHEREAS,the project shall be purchased through the Sourcewell Cooperative Purchasing Program,
20 Contract No. 012621-PPC, for a cost of One Hundred Twenty-One Thousand, Seven Hundred Fifty-One
21 and 85/100 Dollars($121,751.85)plus applicable taxes and fees.
22 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
23 OF LITTLE ROCK,ARKANSAS:
24 Section 1. The City Manager is authorized to execute a contract with ACS Playground Adventures in
25 an amount of One Hundred Twenty-One Thousand, Seven Hundred Fifty-One and 85/100 Dollars
26 ($121,751.85), plus applicable taxes and fees,taxes for Construction Services of a thirty(30)-foot x forty-
27 four(44)-foot Poligon Pavilion for the Western Hills Park.
28 Section 2. Funds will be provided by the Western Hills Park 3/8-Cent Capital Improvement Sales Tax
29 Funds,Account No. 326459-TS45A20 and Legacy Grant Funds,Account No. 270459-G23147.
30 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
31 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
32 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
33 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
34 resolution.

1 Section 4. Repealer. All laws,ordinances,resolutions,or parts of the same,that are inconsistent with
2 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
