Monte: Per our call this morning, since we don’t yet have a determination from the City Attorney’s office on the legal issues raised by Mr. Heffington in the above-referenced action my client is requesting to again defer this item.  The previous deferral from the April 14, 2022, meeting was at staff’s request.  Please defer this item at the applicant’s request until the next regularly scheduled Planning Commission meeting on June 9, 2022. I will forward a response to the City Attorney’s office this week addressing the points raised in Mr. Heffington’s letter of today.  Thanks, Andy Andrew V.
