Per our call this morning, since we don’t yet have a determination from the City Attorney’s office on the legal issues raised by Mr. Heffington in the above-referenced action my client
is requesting to again defer this item. The previous deferral from the April 14, 2022, meeting was at staff’s request. Please defer this item at the applicant’s request until the
next regularly scheduled Planning Commission meeting on June 9, 2022.

I understand from staff that they have not had a chance to review the legal arguments Mr. Heffington raised in his letters from last week and today in the above-captioned matter. Staff
as asked that my client defer this item from today’s meeting so the Planning Commission does not have to hash out a legal argument at today’s meeting. This will also give the City
Attorney’s
office a chance to review this matter. My client is requesting to defer this item to the next regularly scheduled Planning Commission meting on May 12, 2022.
I will forward a response to the City Attorney’s office this week addressing the points raised in Mr. Heffington’s letter of today.
