I understand the confusion since your previous applications might have mostly been COCs due to the scope and type of work being done. The installation of a structure (in this case, a fence) that is visible from the public right-of-way is required by Arkansas law to obtain a Certificate of Appropriateness. Please see Sec. 23-115-123 of the municipal codes for clarity. The Historic District Commission is not a variance-only review process. Staff-level approval is mostly constrained to ordinary maintenance and repair that does not involve a change in design, material or outer appearance and additions or changes that are not visible from a public or private street. The fence is a structure that will be added to the property and be visible from the right-of-way, therefore, requires a COA. As for the fence at 1410 Rock St. I’m not asking for a variance of any kind. The fence plan I’ve submitted will be historically appropriate and well within the guidelines in terms of height and location. Therefore I was under the impression that this is a staff level approval and doesn’t require a full commission hearing. If I were asking for approval for above regulation height, horizontal type of fencing or otherwise inappropriate style, I could definitely see seeking full commission approval. Please advise. The pickets will be 1” W x 36” H and set 3/4” apart. The gates will be 36” W x 36” H Here is a site plan:
