OF THE
BOARD OF ADJUSTMENT
The Board of Adjustment met in the Mayor's Conference Room, City
Hall, Monday, Decerpber 14, 1953, at 2:00 p.m., with the following mem-
bers present:
Mr. Warren Baldwin, Chairman
Mr. Paul Parks
Mr. Bruce Adderson
Docket No. 73-53 - C. R. Collie, Jr., 806 West Second
Street, described as the west 100' of Lots 7, g, & 9,
Block 140, Original City of Little Rock, zoned "G-1"
Commercial; requesting a waiver of front yard space
in order to conform with the established building line
of improvements on adjoining property.
Mr. Collie was present and stated that he plans to remove part of
the old house and build an S foot stairway on the side, thus the house
will have a side yard space of P on one side and 15' on the other. Mr.
Collie ownes two adjoining lots and plans to construct a masonry doctors
office on the other lot. He explained to the members that according to
the "G-1" Commercial Zone just recently established by the Planning Com-
mission and City Council there is a requirement of 25' front setback and
15% off-street parking in that district. Mr. Collie stated that he is
only requesting a waiver of yard space in order to build in line with
the existing buildings on the block. He said that he is in no way con-
testing the ordinance as stated in the newspaper. Mr. Collie said that
he is requesting the waiver of yard space in order that his buildings
might be seen since another structure on the block already extends fur-
ther to the front building line than 251. He explained that he plans
to utilize the back of his two lots for off-street parking.
Mr. Baldwin pointed out the fact that two adjoining residences on
the block will be penalized should Mr. Collie be granted a waiver of
front yard space for their houses would be hidden by the structures on
Mr. Collie's lots.
Mr. Collie replied that he is also being penalized by having to
set his buildings back 251from the front property line since the struc-
ture next to his property extends closer to the building line thus
obstructing the view of his buildings.
Mr. J. W. Matheny, 822 West Sixth Street, was present in interest
of the application. Mr. Baldwin explained Mr. Collie's request to Mr.
Matheny and showed him the plot plan of the proposal. Mr. Matheny stated
that he owns the house on the corner and didn't feel that the granting
of Mr. Collie's application would affect his property too much and there-
fore he did not object to the application. He told the members that
Mrs. Littlejohn ownes the lot between his home and Mr. Collie's lots
and was unable to attend the hearing due to illness. He explained that
he would nx report the requested waiver to her and should she object
then sheowould write a letter of protest to the Board of Adjustment.
Mr. Baldwin pointed out that Mr. Collie proposes to build within 14' of
his front building line. Mr. Matheny stated that he did not object to
the application.
Mr. Anderson made a motion that the application be disapproved;
seconded by Mr. Parks. The motion carried. The members felt that

should the front yard space of 25' be used for off-street parking then
it should cehtainly require that amount of space on which to park an
automobile. Mr. Anderson felt it would be much better to use the front
yard space for off-street parking rather than the rear of the property
since there would be a much easier access to the front.
Docket No. 74-53 - E. J. Bowers representing Pulaski
Heights Church of Nazarene, 4942 W. Markham Street,
described as the south 200' of Lots 1 & 2, Banks Sub
of Block 6, Howard Adams Addition, zoned "B" Residence;
requesting a waiver of more than one structure on one
lot in order to relocate an existing structure and build
a new church on said property.
Mr. Bowers was present and stated that the church ownes a lot of
1001 x 2001 in size. He showed the plot plan to the members and ex-
plained that the house on the back of the lot will be used for Sunday
School purposes. Actually there is also another house located on the
rear of the lot since it is such an exceptionally large lot. Mr. Bowers
explained that the church purchased this property two or three months
ago.
The members felt that due to the large lot the application should
be granted. Mr. Parks made a motion that the application be approved;
seconded by Mr. Anderson. The motion carried.
Docket No. 75-53 - Reaves E. Stewart, (by J. W. Purdom),
2807 Youngwood Road, described as a parcel of land in
Section 25, T-2-N, R-13 4, Pulaski County, Arkansas,
zoned "A" One -Family District; requesting a waiver of rear
yard space in order to construct one story house on the
property.
Mr. Kenneth LeFever and Mr. J. W. Purdom were present to represent
this application. Mr. LeFever showed the members a plat of Kingwood
Addition. He explained that at one time Walthour Flake had not planned
to plat this property into lots with a street running in front of them.
However, they have filed a plat in the Planning Commission Office sub-
dividing the property into lots with a street in front of them. Mr.
LeFever explained to the Board that the owner of this particular lot
will have to build his house within 181 of his rear property line due
to the terrain of the lot. There are no easements on the property. Mr.
LeFever stated that there can never be anything built 6n the corner lot.
Mr. Leslie Grady was present in interest of the application. He
also presented a letter of protest from the property owners adjoining
the property in question at the m.ar . After the plot plan was shown to
Mr. Grady explaining how the structure will be located on the property,
Mr. Grady told the Bca rd that he would have no objection to the house
being constructed on the D roirty provided it is done exactly as shown
on the plot plan. Mr. Baldwin stated that -the Board would grant approval
of the application only as shown on this plot plan otherwise the City
` Engineer would not be authorized to issue a building permit for the
construction. Mr. Grady added that he felt Mr. Harris would not object
to the application if it is constructed as shown on this plot plan.
Mr. Anderson made a motion that the application be approved; sec-
onded by Mr. Parks. The motion carried.
