OF THE
LITTLE ROCK BOARD OF ADJUSTMENT
December 16, 1957
The Little Rock Board of Adjustment met in the Council dkiMber,
City Hall, on December 16, 1967. The following members were present:
Mr. Bruce Anderson Mr. W. H. Marak
Mr. Lloyd R. Pearce
Docket No. 19-57 - U. S. Peoples, 1310 West 16th Street,
described as the West one-half of lot 7,
block 3219 Original City of Little Hock,
Arkansas, zoned "C" Two-family District,
requesting a variance from all applicable
provisions of Section 11 of that ordinance
to permit addition of room to existing
structure,
Mr. U. S. Peoples was present. Mr. Breckling explained his request
Mr. Peoples was asked to wait outside while the Board went into
executive session.
In executive session it was explained that there were three ten
year old buildings. It is an old neighborhood which is "just right for
slum clearance." It would be making a bad situation worse, but taking
the neighborhood as a whole, it could not be harmed much by granting
this request. The Housing Authority has no immediate plan for this
area. It was agreed that this is a hardship case and the man needs
extra room. Mr. Peoples had had no objections from the asighbors and nc
objectors were present.
Mr. Marak moved that it be approved. Mr. Pearce seconded and the
motion carried.
The meeting adjourned at 2:15 P. M.

After a short discussion in executive session Mr. Baldwin moved
that it be approved, Mr. Marak seconded and the motion carried.
Docket No. 16-36 - Lee A. Milam, applicant, (by Lawrence B.
Burrow, Jr., atty.) appealing from a
decision of the Building Commissioner
relative to property'at 2723 Arch Street,
Little Rock, Arkansas, being part of the
WJ NJ SWJ NEx of Section 15, Township 1
North, Rgnge 12 West, Ralph Nelson,
owner, regarding use of this tract as a
storage yard for an automobile rental
business. Applicant seeks revocation of
certificate of occupancy.
Mr. Milam, owner, and Mr. Lawrence Burrow, his attorney, were
present.
Mr. Burlei.gh read the application and reported the staff's finding
He presented a sketch taken from the Sanborn Map. According to it and
Information taken from the Bagley Map, the property is not zoned "F"
Commercial. He showed the members the original newspaper map and
explained the differences in the maps; the newspaper map indicated that
the property In question is zoned 17" and, also, almost all of Mr.
Milam's property is "F".
There was a lerlgthy discussion and comparison of the maps.
Mr. Lawing, Building Inspector was present and stated that in
about July, 19559 there was an attempt to have the lot re -zoned to "I"
Light Industrial Dtitrict.
Mr. Burrow said that on the basis of the assumption that this
property was zoned "B" Residence his client built a brick home. He
explained the type of business which is proposed -. parking yellow
trailers and cars for rent. He said he believed this use would be
illegal and read the list of uses from Ordinance No. 54420 that are not
allowed in this zone. It was brought out that when this ordinance was
written, this type of trailer was not being made.
Mr. H. B. Stubblefield, attorney for Mr. Ralph Nelson, property
owner., read from Ordinance No. 5420, page 47, concerning appeals. He
said that for over six years and until approximately one year ago this
property was used for a welding shop and Mr. Milam could not have built
h1s home thinking it was zoned for anything but "F".
There was discussion of requiring Mr. Nelson to build a fence
between his lot and the residences, Mri Nelson said he obtained a
certificate of occupancy and building permit on December 3rd and fools
that he has done all that he should be required to do to use it for
commercial purposes. Mire Miiam said he would have no objections if the
fence were built.

In executive session Mr. Baldwin said this property has been used
for commercial ever since he can remember and he has no doubt that it
is zoned 0 P",
After a lengthy discussion with the building inspector and the
city engineer, Mr. Stephens said briefly that the rosin contention was
whether or not the use is permitted in "F". The inspector, the
engineer and the staff were of the opinion that it would permit this
use. Miss Penton suggested and the Board agreed that the Board*s
decision should not effect any property other than the lot in question.
Mr. Marak moved that the Board approve the use of this lot, Mr.
Baldwin seconded and the motion_ carried.
There was no further business and the meeting adjourned.
