HomeMy WebLinkAboutboa_11 18 1957MINUTES OF THE MEETING OF THE LITTLE ROCK BOARD OF ADJUSTMENT NOVEMBER 189 1937 The Little Rock Board of Adjustment met in the Council Chamber, City Hall, on November 189 1957 at 2:00 P. M. The following members were present: Mr. W. H. Marak Miss Emily Penton Sinoe a quorum was not present, the cases were heard by the members present, but final action was withheld until other members Gould -be presented with the details of the hearing. Docket No. 1&57 - Morris Smith for Dr. Charles T. Roberts, S. W. corner of West 6th and Victory Streets described as lots 1, 2, and 3, block 343t Original City of Little Rock, Arkansas, zoned "D" Apartment District, requesting a variance from the rear yard provisions of Section 12 of that Ordinance to permit construction of dental clinic building. Mr„ Smith, Dre Roberto and Mr. Dan Cowling, attorney, were present Mr, Smith explained that the basis for the request is to provide off- strDet parking and utilize some of the unused apace, They had hears na objeotiorA and the staff had r*oolved none. In e;ceoutive session all -voting was carried on eubjeet to the approval of another Board member. Mr. Marak moved this request be approved, Miss Penton seconded. -Docket, Now 14-47 - Lora MoCvaT, 1200 Cumberland Streets described as lot 12 and the north 12.5 feet of 119 block 229 Original City of Little Rock, Arkansas, zoned "D" Apartt- ment Distriat, requesting a waiver of more tban one ruin structure on a lot so that the existing garage apartment Page 2 of 3 can be converted into a church, a vari- ance from 2-5 of Zoning Ordinance No. 5420. This docket was deferred from the October meeting because of inadequate notification of the surrounding property owners due to a misunderstanding on Mrs. McCray's part. She understood that the owners of property within 140 feet of the building instead of the property lin were to be notified. The notice of hearing was properly signed and mailed to the office and Mrs. McCray was present to present her case again. There was discussion of the extent of repairs, number of people the building would seat, w,ether or not it would be practical to use the residence on the front of the lot for the church, off-street parkin and (church office buildin-_,-n:ith adequate off-street parking'is available jua t acrvas the street) future plans for building a new churc-. where the residence now stands. Mr, Marak read two letters of objection which had been received by the staff and Mr. Burleigh said they were invalid. In executive session Mr. Marak said he did not see how the Board could deny this request, The residence was not suitable, there was no parking problem, a church would not depreciate the Value of the adjaoen property. The safety factor was discussed. It should comply fully wit' the building code. Mr. Marak said he could see nothing particularly detrimental as a second use. If the church succeeds they will acquire the residence and then it will be for only one use. Mr. Marak moved that it be approved provided there is full com- pliance with the Building Code, Miss Penton seconded. There was to be no expansion - only repairs and remodeling. Docket No. 13.57 - J, G. Botsford, 1512 Center Street, described as lot 10 and the north half of lot 90 block 1920 Original. City of Little Rock, Arkansas, zoned "D" Apartment District, requesting a variance from all applicable provisions of Section 16 of that ordinance to permit construction of a brick garage apartment.' Mr. Botsford was present and stated that he wanted to go knack to the original plan to stay 25 feet from rear property line and 9 feet from side. He stated that the Board had already approved this plan, bui he had wanted to change it; he sees now that this plan is better and that he is willing to tear down the old garage if he is allowed to builc this building. There was discussion of the fire code - Southern Building Code - Mr. Burleigh said 6 felt sounded all right to him. There was discussion of Board membership and whether or not to invite the Board. of Directors to meet with the Board of Adjustment.
