LITTLE ROCK BOARD OF ADJUSTMENT
MINUTES
October 21, 1957
The Little Rock Board of Adjustment met in the Council Chamber, City
Hall, on October 21, 1957 at 2:00 P. M. The following members were present:
Mr. W. H. Marak, .Acting Chairman
Mr. Lloyd R. Pearce
A public hearing was held on the following dockets:
Docket No. 16-57
Lora MlcCray, 1200 Cumberland Street, described as lot 12 and the
north 12.5' of 11, block 22, Original City of Little Rock, Arkansas
zoned "D" Apartment District, requesting a waiver of more than one
main structure on a lot so that the existing garage apartment can
be converted into a church, a variance from 2-5 of Toning Ordinance
No. 5420.
Mrs. McCray was present. Mr. Burleigh explained her request to the
Board members and located her property on the Sanborn map. This request
constituted two main structures on a single lot.

Pars. McCray said that she intends to remodel the garage apartment and
use it for a church, then later build a church building.where the resi-
dence now stands and use the remodeled garage for Sunday School rooms.
Mr. Burleigh asked her to tell the Board the extent of her remodeling plans.
She said she would have some concrete work done, sheet rock, and build a
vestibule. She explained that there was water and a lavatory there, but no
gas. Mr. Burleigh asked Mrs. McCray about how much she thought it would
cost to fix it up? She said she had had an estimate of one thousand dollars,
but her brother had promised to estimate it for her and she expected it to
be less.
The notice of hearing which Mrs. �McCray returned had only three signa-
tures. Then questioned about this she said she understood that she was to
notify propertyowners within 140, of the building instead of the lot line.
In executive session Mr. Pearce said that since the surrounding proper-
ty owners had not been properly notified he would recommend that it be held
in abeyance until the neighbors could be polled.

Thelma D. Karcher, 4800, 4810, 4812, 4816, 4814 ?:rest 12th Street,
described as lots 1, 2, 3, 4, 5, and 6, block 28, Cunningham's

Addition to the City of Little Dock, Arkansas, zoned "F" Commercial
District, requesting a variance from the rear yard space provisions
of Section 13 of "oning Ordinance No. 5420 to permit the owner to
construct a building on lots 1 & 2, block 28, the rear of said
building to be within 12 1/2' from the center of the alley and 5'
from the rear property line.
Mr. Raymond Block, Sr., Block Realty Co., was present and explained
the request. This will be the home of a National T food store. The
area of the building will be 100' x 1101. There will be no outside gar-
bage or burning of trash. (all burning will be in an incinerator) The house
on the property will be removed.
There was a lengthy discussion about the placement of the building
on the lots, distance from the center of the alley, paving of the alley
and Monroe Street, also, the advantages and disadvantages of closing
Monroe Street. NIr.'McNutt, who owns property across the alley, was
present. He said he did not object to the requested waiver, but wanted
the alley and Monroe Street paved, if possible, and a high board fence
placed on the north side of the alley. Mr. Burleigh mentioned that the
city might be interested in acquiring some lots nearby..
Mr. Block said he could not commit himself to say that the National
T, Food Co. would pave I'Tonroe, but that they planned to pave the alley.
Their plan shows a setback of 14, from the side instead of the required
4', but 117r. Block did not know if. this is their final plan. The loading
and unloading will be from the side. He urged the Board members to ap-
prove this, subject to whatever they wanted done and he would notify his
client. He did not think they would object to putting up the fence.
-'r. NcNutt said his main objection would be solved if the fence were
built. It is possible that some will not want the fence, the church and
especially, the _one,_,who has g garage.. opening,, onto_; the :a11ey.
After thorough discussion in executive meeting I.r. ilarak and Mr. Pearce
agreed that they would approve this request, provided they set as far back
as possible from h;onroe Street and provide a six foot painted board fence
or comparable screening for those property owners on the north side who
desire such a, screen.
then PJr. Bruce Anderson, a member of the Board of Adjustment, was
contacted later in the day he was in accord with the other members in
approving this docket with provisions as stated.
Docket carried over from the meeting of September 16, 1957:

J. G. Botsford, 1512 Center Street, described as lot 10 and the
north half of lot 9, block 192, Original City, zoned "D" Apartment
District, requesting a variance from all applicable provisions of

Section 18 of Zoning Ordinance .No. 5420 to permit construction
of brick garage apartment.
11r. Botsford was present and Ifir. Burleigh briefed the members on
what transpired at the September meeting. Mr. Botsford wants to build
a garage apartment on the back of his lot, 13' from the line instead
of the required 25'. The neighbors do not want the alley closed. He
would be almost in line with the other buildings. The old house on
the front is the only one -family residence in this "D" Apartment
District.
There were no objectors present and Mr. Botsford said he had heard
none. It was thoroughly explained to Mr. Botsford the trouble he would
have when he decides to tear down the big house to rebuild.
In executive meeting Mr. Pearce said he could see no objections,
the main structure is in deplorable condition, but that it should be
made plain that if he rebuilds on the front of the lot he will have to
appear before this Board again before he can get a building permit.
Mr. Burleigh said if Mr. Botsford was required to observe the 25'
building line the apartment would be close enough to the front that it
could be attached to the new structure and then he would not have two
main structures on one lot.
1.1r. 1�arak suggested that this be ?gassed and the decision left up
to Er. Anderson, since he had made a study of it, then he and 1"1r. Pearce
would go along with his decision.
T,;r. Anderson was contacted later the same day and stated this re-
quest should be denied.
Mr. Anderson was also contacted in regard to Docket No. 16-57 and
agreed with Mr. T:arak and Mr. Pearce that it should be held and no
