D. Kerr, Democrat Reporter A quorum was present and the meeting was called to order. III. New Matters (Advertised), Docket No 64-62 Applicant: Glenn H. Johnson, M.D. Location: Tract 15, Riverside Commercial Park Description: West Rock Addition Classification: "F" Commercial District Variance: Requesting permission to locate a public garage (automatic car wash) as a special exception of Section 18.5 of Ord. 5420 Glenn H. Johnson, Jr. was present to represent this application. He told the Board that the car wash business would be an attractive, modern plant costing about $250,000. The proposed site is at the northeast corner of Cantrell and Cedar Hill Roads. Protests against the car wash came from J. Wythe Walker, president of the Cedar Hill Corp., which plans a $2 million luxury apartment project across Cantrell Road from the proposed car wash site. He contended that a car wash business would be too noisy to be placed near a residential -type development. An architect, Mr. Bob Robinson, reported on a study of the sound from a car wash business in support of the argument. Thomas E. Downie, an attorney representing Winrock Enterprises, also objected to the car wash. Winrock is developing land cleared for residential use in the renewal area. George D. Miller Jr., assistant executive director of the Little Rock the c ousiig Authority said the authority had agreed to sell the land to Dr. Johnson the Board of Adjustment approve his request for a car wash. (2) In executive session, Mr. Meeks made the motion to deny this application. Miss Penton seconded and it carried unanimously. Mr. Farrell disqualified from the discussion and voting. Docket No. 65-62 Applicant:: Leroy Butler Location: 4918 Westwood Avenue Description: Lot 15, Block 5, Westwood Addition Classification: "A" One -family District Variance: From the side yard provisions of Section 11 of Ord. 5420 to permit construction of a carport. Mr. & Mrs. Leroy Butler were present to represent this application. There were no objections. The question was asked if the carport would be open. Mr. Butler said that it would be. In executive session, Mr. Meeks moved that the proposed variance be approved. Miss Penton seconded the motion and it carried unanimously., Docket No. 66-,62 Applicant: B. T. Harris Location: 5418 Asher Avenue Description: Block 12, Toska Leymer Addition Classification: "F" Commercial District Variance: From the front and rear yard provisions of Section 13 of Ord. 5420 to permit more than one building on a lot. Mr. Max Harris was present to represent his application. The question was asked if the garden center in back would be moved to which Mr. Harris said that it would, Mr. Harris stated that the existing building was King Furniture Store and they needed the variance for an accessory building for storage purposes. The access would be on the west side and the east side and the street doesn't go any further than the proposed building. There were no objections. In executive session Mr. Farrell made the motion to approve this request. Mr. Marak seconded and it carried unanimously. Docket No. 67-62 Applicant: H. C. Coburn Location: 2621 Kavanaugh Description: Lot 12, Block 16, Pulaski Heights Addition Classification: "F" Commercial District Variance: From the front, rear, and side yard, and off street parking provisions of Section 13 of Ord. 5420 to permit construction of a canopy and building. Mr, Coburn was present. He stated that the proposed variance would be an improve- ment to the area and that the extension would be to the present building. He said that the new building would be in line but it falls back at an angle for loading at the back door. As to the type of construction, the building will be masonry and the old building will be torn down. There were no protests. In executive session, Miss Penton made the motion to approve this application. Mr. Meeks seconded the motion and it carried unanimously. (3) Docket No. 68-62 Applicant: Alvin J. Reap, Jr. Location: 1204 Pine Valley Road Description: Lot 343, Kingwood Place Classification: "A" One -family District Variance: From the rear yard provisions of Section 11 of Ord. 5420 to permit construction of a den. Mr. Reap was present, The Board pointed out that in back of his house was a.creek and a hill. Mr. Lyons asked if he had public utilities to which Mr. Reap replied that he did, In executive session Mr. Marak made the motion to approve this variance with Miss Penton seconding. It carried unanimously; a corrected plot plan was to be presented to the staff, Docket No. 69-62 Applicant: Elro-,k Development Company Location: Meadowlark Subdivision Description: Lot 6, 15, 42, 44, 58, 59, 65, 98, 106, 113, 115, 130, 129. Classification: "A" Residential District Variance: From the front yard provisions 72, 78, 79, 88, 97, of Section 13 of Ord, 5420, Mr, Bill Graham was present to represent this application. Mr. Graham asked the- Board to permit this variance in order to relieve them of the 25' restrictions. They want to move the houses closer to the street. He felt in turning the houses at an angle, it would enhance the subdivision. He said the closest point to the street on any of the houses would be 17' with one exception, One would be 15'.on Vancouver Drive. Mr. Lyons asked if the carports would be open or closed, Mr. Graham said that some would be open and some closed, He could not say as to which ones. No building could be erected closer than 8' to the property line, In executive session, Mr. Meeks made the motion to approve Lots 6, 15, 65, 72, 78, 79, 115, 113, 106, 130 and denied.88, and 1,29, and asked that plot plans be submitted on Lots 42 and 44. The Board also asked that the houses be repositioned on Lots-98, 97, 59, and 58. Miss Penton seconded the motion and it carried unanimously. The motion provided that the projecting portion of building could only be an open carport. 1Jocket No,70_62 Applicant: S. Treitman Location: 2206 Dennison Description: Lot 166, Adams Addition Classification: "B" Residence District Variance: From the front yard provisions of Section 13 of Ord. 5420 to permit construction of a bedroom. Mr. Treitman was present to represent the application. Mr. Breckling explained to the Board that the street was relocated in the urban renewal project and did not leave him much front yard for the house. Mr. Farrell made a motion to approve this request with Miss Penton seconding. It carried unanimously, r■ W n. 00 (4) Docket No 1-62 Applicant: Jean Crow Location: 5600 West 12th Description: Block 19, Rapley Estates Addition Classification: "B" Residence District Variance: From the front yard provisions of Section 13 of Ord. 5420 to permit construction of a bedroom. Mr. Jim Lewis was present to represent this application. Mr. Lewis stated that there was a small bungalow that has been partially burned, now on the proposed tract of land. Three adjacent property owners were present. Mr. Lewis explained to them that he was aware that the two feet beyond the retaining wall was their property. He said that he would tear down the old wall and build a new one on the property line. The people said that they were in favor of this and that it would definitely be an improvement. In executive session Mr. Meeks recommended that this application be approved. Mr. Farrell seconded the motion and it carried unanimously. IV. Other Matters (Advertised) Applicant: Joe D. White Location: 10 Talmage Drive Description: Lot 15, Talmage Forest Classification: "A" One -family District Variance: From the front and rear yard provisions of Section 11 of Ord. 5420 to permit construction of a single family house. This application was deferred because all necessary data had not been turned in. Docket No._61-62 Applicant: Francis Hewett Location: 1821 Dennison Description: Lot 8, Block 21, Park Addition Classification: "C" Two-family District Variance: From the front and side yard provisions of Section 11 of Ord. 5420 to permit construction of a bedroom and den. Mr. Hewett was present. The Board asked him if the alley was open to which he replied it was. When he bought the house, a carport had been constructed without a building permit. The Board decided not to take any action about the carport since it has been in existence for approximately four years. Mt. Farrell made the motion to approve this request. Miss Penton seconded and it carried unanimously. 3 W W 15 Is (5) Miss Penton moved that the Board commend Julius Breckling on all his hard work on the Planning Commission and express their appreciation for all he had done for the Board of Adjustment, ************* The meeting was adjourned at 3:47 P,M.
