Variance: Requesting more than one building on a lot
of Section 29. Ord. 5420 to permit retail
business.
Mr. Brown, Attorney, was present to represent this application.
Mr. Brown stated that Mr. Berry had two existing rent houses on
the back part of the lot. Mr. Berry desires to put proposed
building on the remainder of the tract. The grocery store has
been there for about 15 years.: Also, on this tract, is Chip's
Dairy Freeze. The grocery store is now under a Bill of Assurance
but there is an amendment to the Bill of Assurance under way. The
point of contention is over the 70 feet which the two rent houses are
part of.
Mr. Youngblood was there to object. His only objection was that the
70 feet, which was part of his backyard would not be zoned commercial.
Mr. W. E. Willis, Lot 32, stated that he did not want this proposed
change to cut the value of his property. Mr. J. R. Ry an and
Mr. B. L. Wilkins was also there to protest. Mr. Youngblood asked
if any unloading of the trucks would be done on the back lot. They
said it would not.
Mr. J. R. Ryan, representatile of several property owners in the
area, expressed that they had no objections to Mr. Berry's opera-
tion nor to the rezoning to "commercial". He did , however, say that
the people want the south 70 feet to remain residential.
The question was asked if the drive would be paved, to which they
answered it would be. There were no further objections.
In Executive Session, Mr. Meeks made the motion to approve this
application provided some arrangement be set with the property
owners and the Planning Commission that the south 70 feet of the
West 225 feet be preserved as "A" Residential District. The
motion was seconded and carried unanimously.

Mr. Cox was present to represent Elmo Woods. Mr. Cox stated that
this property is zoned "F"-Commercial and that the lots faced
State Street, but they want the building to face 14th Street.
To make this possible, it would have to be set back 12J feet on
State Street, 25 feet rear yard space. There will be 20 feet
setback -on the alley. Mr. Cox said that Mr. Woods now operated a small
applicance shop on this tract. He wants to build a radio station.
He was asked about parking. Mr. Cox said parking would be in the
20 feet setback from the alley.
Mr. Otis Walker, 1406 State, was present. He did not object,
just wanted to know what they proposed to build. Mr. Cox said
it would be a Broadcasting Station, no tower.
In Executive Session, a motion was made to approve this application
provided it complys with parking requirements and provided the
wall remains and that screening be provided along the parking lot
along State Street. The motion was seconded and carried unanimous-
ly.
IV. Other Matters (advertised)

The Board of Adjustment recommended an amendment be submitted to
the Planning Commission whereby a nonconforming building could be
structurally added to provide that the following conditions had
been complied with:

requirements of this chapter and the building code.

area occupied by existing encroachments, extensions or projections
into a required yard space shall not exceed the total lot area
allowed by this chapter for new construction.
(D) that no part of the existing nonconforming building shall
encroach, extend or project into more than forty percent (40%)
of any one (1) sideyard distance required by this chapter.
(E) that no part of the existing nonconformin g building shall
encroach, extend or project into more than thirty percent (30%)
of either the front or rear yard distances required by this
chapter.
(F) that no part of the existing nonconforming building shall
encroach, extend or project into more than one yard space distance;..
required by this chapter.
(G) that such erection, conversion, reconstruction or structural
alteration shall fully conform to the yard space and all other
applicable provisions of this chapter required for new construction.
NOTE: The Flannin g Staff was requested to review this matter with Mr.
. Meeks after the terminology has been clarified.
Correction
It was felt by the Board of Adjustment that the minutes of May 219
1962 concerning the Anthony School Application, should be clarified.
The Board directed the secretary to make the following correction.
Mr. Anthony stated that he would remove the variance for more than
