III. New Matters (Advertised) Docket No. 53-62 Applicant: Cedar Hill Corporation Location: NW corner of Highway r`10 and Cedar Hill Road Description: Apartment Tract A-1, Cedar Hill Terrace Classification: "D" Apartment District Variance: From Section 17A and Section 12 to permit t-o or more build- ings on one tract and a variance to permit buildings to be erected to a height of 10 floors plus an elevator penthouse, not to exceed 130' Mr. Farrell abstained from voting and the discussion since he had an interest in this application. They are asking for the same waiver they were granted a year ago. (For more than one building on a lot) The biggest change is two main structures have been moved so that both buildings face East. That was dictated for two reasons: (1) View was better (2) Soil conditions were poor. Mr. Bob Robinson was present. He stated that the apartment would have 40 units. There would probably be 8 or 10 units to one building. The question was asked how many square feet in the property to which he replied 350,000 square feet. There was one person there to protest. She didn't like the height of the build- ing. She said it was directly between her house and the valley. She felt that this building would obstruct the view and it would block Dr. Haney's view. Mr. Robinson indicated that they had designed it in order to protect the view. In executive session Mr. Meeks moved that this proposed variance be approved. Mr. Marak seconded the motion and it was carried unanimously. P age 2 Docket No, - 54-62 Applicant. Location: Description: Classification Variance The Little Rock Board the next meeting Docket No — 55=d2 Louis Rauton 516 Rice Lot 8, Block 28, Capitioi nill Extensior "B" Residence District From all applicable provisions of Section: 11 of Ord, 5420 to_permit construction of a duplex of Adjustment moved that this application be deferred until Applicant- First•Pen-tecostal Church by ` Rev.: G7' .T.- Brown Location_ 501 505_.Vetory Description. Lots 1 and 2_Block -331, Original City Classification: "E-l" Quiet Business ind:Inst2.vutional District Variance, From all applicable provisions of Section 12=A of Ord 5420 to permit construction of an educational building Rev: G; H, Brown and Mr. Lewis was present Mr_ Breckling said the plot plan was not correct and that it would have.to be-cotrected_ It'didn°t show the house adjoining the church. The question -was asked as tq what provisions for parking id they have Rev, Brown said that they'had an agreement with Safeway to park at night and on holidays -and also - with Mr- Smith; who owns property in the back. The seating capacity of the church is between 200 and 250- Bill Stocks said they would have io have a written agreement as to their parking, Mr- Meeks suggested that Rev, Brown submit the written document for parking to the City Attorney to get his okay before acting on this variance .and also have the plot plan corrected - The application was deferred until the.next meeting: Docket No 56-62 Applicant, Transportation Properties,. Inc. by R, A, Lile Locations 905 West Third Description' Block 253; Ordginal City Classification, "G-1" Commercial Variance° Requesting location of a public garage in a Commercial District as a special exception and a 101 Front. yard Mr, Kenneth Graham was present to represent this application- He stated that the building would be a multi -purpose building There would be no entrance on Third Street, It will be on Izard on the East side at the'rear; He said they would eliminate strings of lights and would probably put up mercury lights and use just as few as possible and just put lights on the front, There would be no Sunday activity. The alley is the access on the south portion of the plot of ground,. One lady asked about the structure to which Mr. Graham replied it would be'�a brick building, Mr;, William Nash was there and said that this property was zoned "G=1" and the owner may operate a garage to retail sales agencies, He said the people would be comforted by the fact to know that the building would not be used during night and that it would not be used as a public garage. The Page 3 people would be satisfied if it were a service area but asked the Board to deny it to be used as a public garage. Mr. Spitzberg stated that unless some type of wall was erected between the proposed plot of ground and the adjacent property owners that cars would be getting into the lady°s yard. John Haley said that any type of operation would be in the people's favor that he represented but required reasonable hours and asked that some of the lights be screened so they wouldn't bother them at night. He also said the public garage should be eliminated, Mr, Spitzberg asked if there were any assurance that the business would not be operated at night. Mr. Graham said that Mr. Elroy Martin gave the assurance very definitely that they would close around six or seven, He also said that this operation would not be used to repair big busses or trucks, just their cars. There were no written objections. Mr. Meeks made the motion that this proposed variance be approved subject to the following conditions. (1) Front setback line be 15 feet, not 10 feet, (2) That the garage should be operated only in connection with new car sales (3) That a bumper high curb be installed on West property line, (4) That lighting be screened away from ajoining property, Mr. Marak seconded the motion and it was carried unanimously. IV, Other Business Applicant-. Locationz Description: Classification, Variance Mrs. C, M. Seward 316 South Cross Street N 1/2 Lot 8, S 1/2 Lot 9 "Go.1" Commercial District From the side and front yard provisions Sec. 14-A of Ord.- 5420 to permit construction of living room, porch and bed- room, Mrs. Seward was present for a re -hearing for an addition to the front of her house, She said that she wanted to extend her house out 121 even with the other houses, There is a vacant lot between the next house and her building. The plat shows the room to be 20 x 15 but she wants it 20 x 170 Mr, Meeks made the motion to approve this variance and Mr. Marak seconded and it was carried unanimously. Docket No. 46-62 Applicant, Carson Bray Location- 2504 Scott Description: Lot 11, Block 16, Original City Classification. "E" Apartment District Variance- Requesting a carport 30 x 50 on the rear 30' of the lot as a special exception Mr. Carson Bray was present. He wants to build the carport for storage of his cars and trucks, His business is next to this lot, The new building 30 x. 50 would take care of his needs, He wants to put the entrance from the alley, Page .4 y Scott Farrell made the motion to approve this variance provided the garage be open on three sides 5 feet on each side, Mr. Meeks seconded the motion and it carried unanimously.
