A quorum was present and the chairman called the meeting to order.

Variance: From the side yard provisions of Sec. 11,
Ord. 5420 to permit construction of a
room onto existing house
Mrs. Otis Nichols and Stewart Nichols were present. Chairman asked how the
neighbors felt about this request and there were no objections.
Mr. Meeks made a motion to approve this request. The motion was seconded by
Miss Penton and carried unanimously.

Variance: Pursuant to Section 18-4 of Ord.
5420 requesting permission to locate a
parking lot in a restricted district
Mr. Dixon and Mr. W. C. McMinn were present. Mr. McMinn`s office building on
1601 Maryland, has approximately 33 offices, and he wants lots 7 and 8 for
parking lot for the employees. The lot will park about 40 cars, will be black -
topped, and have shrubbery. The lot will be private, in and out parking.
Mr. McMinn feels this will be an improvement over the present use of the property,
which is gn unoccupied building that is about 100 years old and very dilapidated.
Mr. Henry Spitzberg, spokesman for a group of eight objectors was present. lie
stated that this was a residential area and that there had to be a stopping place
somewhere on Commercial buildings intruding on residential districts. Mr.
Spitzberg stated that this parking lot would interfere with the privacy of the
residential area.
Mrs. Francis Wood, Mrs. McClain, A. T. Thompson, Mr. Morrison, Mrs. Thompson,
Mrs, Hoffman, 1-1. M. Peel, all living in the same block as proposed parking lot,
state that the parking lot would ruin the value of their property and intrude
on their privacy. They also feel that the parking lot would be harmful to
their health since they leave their windows open and the dust and fumes would
come through the windows.
Mr. John H. Brown, whose property is located at 1614 and 1616 Maryland, feels
the proposed parking lot would be an improvement over the old existing building.
He states that the building is falling down, is unkept, and is a nesting place
for snakes and ray
The B oard recommended this be deferred for further study until the next meeting.

Since the construction of an open carport on the front of the house would be
right on the front property line, Mr. Meeks made the motion that this request
be denied. The motion was seconded by Miss Penton and carried unanimou�;,.Y.

living room, porch, and bedroom,
Mrs. Seward was present. Mrs. Seward stated that she wanted to extend her living
room onto the porch, then build a new porch, and wants to add a room in the back.
The addition to the back may be used as a bedroom and an extra bathroom for renter:
A motion was made by Mr. Meeks to permit the addition on the back of the house
but that the construction on the front of the house be denied. The motion was
seconded by Miss Penton and carried unanimously.

North Tyler Street
Description: West 1/2 of Block 16, Hollenberg's
Addition
Classification: "B" Residence District
Variance: From all applicable provisions of
Section 11 of Ord. 5420 to permit
building of a proposed addition
Presently this space is used for shcool yard and the reason for variance is to
permit the addition of class rooms. There were no objections. Miss Penton made
the motion that this request be approved. Mr. Meeks seconded the motion. The
motion was carried unanimously.

Description: East 1/2 of Lots 7, 8. and 9. Block 10,
Pulaski Heights Addition
Classification: "A" One -family District
Variance: From the side yard provisions of Sec. 11
of Ord. 5420 to permit construction of a
carport.
The carport is to take the place of the garage that is now occupying the proposed
variance. Mr. Meeks made the motion to approve this variance provided the garage
is torn down. The motion was seconded by Miss Penton and carried unanimously.

Classification: "K" Heavy Industrial District
Variance: From the provisions of Section 8
of Ord. 5420 requesting approval of the
location of a Poultry Processing plant
in a "K" Heavy Industrial District.
Mr. Dean Williamson was present. Mr. Lyons asked what type of building would
be constructed, to which Mr. Williamson stated that it would be a brick and
concrete building. Mr. Williamson was asked what the balance of the property
would be used for. He stated that it would be used for parking area.
Mr. Marak made the motion that the proposed variance be approved. The motion
was seconded by Miss Penton and carried unanimously.

Classification: "C" Two-family District
Variance: From the front and rear yard
provisions of Section 11 of Ord. 5420
to permit construction of a new church
and an educational building
Mr. Christopher Mercer and Rev. Frank Henderson, pastor, were present. Mr.
Mercer has the Little Rock Housing Authority's approval and none of the
adjoining property owners object to the new structure. The church owns the
property in back across the alley and plan to use it for parking area.
Mr. Meeks made the motion that this variance be approved if additional land
in back across the alley be used for parking lot. Miss Penton seconded the
motion and it was carried unanimously

Variance: From all applicable provisions of
Section 11 and from the provisions of
Section 18-4 of Ord. 5420 to permit the
location of a school in a restricted district.

Mr. Allen D. Anthony was present. Mr. Anthony stated this would be an elementary
school accommodating approximately 100 youngsters. Mr. Frank Wells stated that
this was not a public school but a school for profit and that it was under no
local supervision. Mr. William Thomas Dix objects to having the school built
because the people in the neighborhood would not be using the school. Mr. Dix
had the signatures of 15 families opposing the variance for the following reasons:
(1) Their property value would depreciate (2) Families would be deprived of
a quiet neighborhood (3) Streets are not designed for large increase in traffic
brought about by the school (4) Increase in traffic would be hazardous to their
children (5) The school can offer nothing which they don't have access to
already.
Mr. M. L. Henson, developer of the addition feels that this would hurt his
development because this area is an "A" One -family District and people wanted
a quiet, peaceful neighborhood.
The Board deferred action on this variance until the next meeting and asked the
staff to secure legal opinions from the City Attorney's office.

Variance: From the front yard and height provisions
of Section 13 of Ord. 5420 to permit
construction of three story motel
Mr. Philip G. Back was present. Mr. Back pointed out that the Travel Lodge
located on the Northeast corner of West 5th Street and Cumberland had been
constructed without providing the 25' front yard as requested in the "F', Commercial
District. The zoning was later checked and found to be "H" Business which requires
no setback requirements.
Mr. Meeks made the motion that this variance be approved provided the height
regulations be complied with. The motion was seconded by Miss Penton and
carried unanimously.

Classification: "E" Apartment District
Variance: From the rear yard provisions of Section 12
of Ord. 5420 to permit occupancy and rental
of storage building
The Board of Adjustment approved the request because there was a hardship involved
in this case, but that the building must be vacated in 18 months beginning June 1,
1962, for rental purposes.

Classification: "I" Light Industrial District
Variance: From all applicable provisions of Sec. 14
of Ord. 5420 to permit location of an office
building on the front part of the tract
in question. The office would be used for
a used car lot.
The applicant pointed out that he would set back his wrecking operation 150 feet
on the East side of the Wrecking yard and 70 feet on the West side. On the West
side there is a fill and he proposes to build a fence four or five feet high on
fill to hide the lot from West side.
The Board asked the applicant to submit a plan for this proposed fence.
