Meeks MEMBERS ABSENT: Emily Penton STAFF PRESENT: Julius Breckling, City Planner Melba Lawing, Secretary Zelda Turner, Secretary OTHERS PRESENT: Jerry Donoho, Gazette Reporter Bill Stocks, Assistant City Attorney A quorum was present and the chairman called the meeting to order. An advertised public hearing was held on the following dockets: Docket No. 12-62 Applicant: The Most Reverend Albert L. Fletcher by Thomas J. Bonner, Attorney Location: Ninth and Ferry Streets, Northwest Corner Description: Long Legal Classification: I'D" Apartment District'- Variance: From the front, rear. and side yard space, one main build- ing on a lot, and the off-street parking requirements of Ordinance No. 5420 Mr. Thomas Bonner, attorney, and I,Ir. Heigle, architect, were present. Mr. Bonner said that the property was entirely owned by the Bishop, except for the Northeast corner, and that there were two residences on the property. He said that there is now 11.6 feet between the building and the street. After comple- tion of the planned parking spaces, the building will be ten feet from the property line. He stated that the school auditorium had a seating capacity of 416 and that the required number of parking spaces for this number of people is 41. Only 37 spaces are provided. Mr. Breckling asked Mr. Bonner if the church had any plans for removing the two residences. Mr. Bonner replied that it did not, since they received $150.00 a month for rent from these two res- idences and they need the income. In executive session a motion was made by Mr. Meeks that this docket be approved, stipulating that before they come for any other variance, they remove residences on Ferry Street. The motion was seconded by Mr. Marak and tried unanimously. Page 2 of 3 Docket No. 11-62 Applicant: James L. Fleming Location: 6209 "I" Street Description: Lot 2, Subdivision of Block 15, Pleasant Hill Addition Classification: "A" One -family District Variance: From the side yard provisions of Section 11, Ordinance No. 5420 to permit beautification of home and utili- zation of carport and storage area. Mr. Fleming was present. He had photographs of the property. He stated that his neighbors did not object to this proposal. He said his driveway is 12 feet wide, and that the minimum requirement is only 7 feet. Mr. Anderson asked if this was to be an open carport and Mr. Fleming replied that it was. He said that it would be on the line with the driveway. His lot is 70 feet by 140 feet. In executive session Mr. Marak made a motion that this proposal be approved. The motion was seconded by Mr. Meeks and carried unanimously. Docket No. 14-62 Applicant: Western Meatpackers, Inc. Location: 4800 West 33rd Street Description: Long Legal (2 parcels) Classification: Proposed "I" Light Industrial District Variance: Requesting permission to locate a stockyard and slaughter of animals in a "K" Heavy Industrial District Mr. Brown was present. He said that a 200 foot strip of land around the tract had been deleted from the application. He stated that the proposed build- ing would be one thousand (1,0001) feet from the nearest residential area. He said that he is now asking that the property be rezoned for a "K" Heavy Industri.. al District use of the property. If the property is rezoned to "K" Heavy Industrial District, the Board must still approve this use. Mr. Brown desires to erect office buildings and expand the present operations. In executive session Mr. Anderson made a motion that the proposal be ap- proved subject to rezoning. The motion was seconded by Mr. Meeks and carried unanimously. Docket No. 15-62 Applicant: Floyd Fuikerson for Mary Westover Estate Location: 1,000 and 912 Hanger Street Description: Lots 11, 12, 13, Merchantile Trust Subdivision and the North 100 feet of the Northeast 1/4 of block 4, Hanger's Addition Classification: "C" Two-family District Variance: From the rear yard provisions of Section 11, Ordinance No. 5420 to permit construction of a building Page 3 of 3 Mr. Fulkerson was present. He stated that his client wishes to erect a ware- house on the property. The zoning ordinance requires ten feet rear yard where such a lot joins a residential area. He said that his client has the building which she wishes to place on the property. His client has deeded a ten foot strip to the city to be used for future street improvements. The property is presently zoned "I" Light Industrial District. Mr. Marak asked what kind of construction was the building and Mr. Fulkerson replied that it was constructed of concrete, steel super -structure, and has a galvanized roof. He stated that the building was under an architect's supervision. He said the building contains seven thousand (7,000) sgare feet for parking. Mr. Reed, of 911 College Street was present. He said that he did object to the building being permitted to be extended to the property line and he felt that this would not be desirable for the property owners along College Street. In executive session it was determined that if this proposal was approved there would be three buildings on this tract. The Housing Authority feels that an "I" Light Industrial District classification would be adequate for Hanger Street and a "C" Two-family District classification for College Street. Mr. Marak made a motion that this proposal be approved with ten foot setback from the rear of the property line. The motion was seconded by Mr. Anderson and carried unanimously.
