There being a Quorum, the meeting was called to order by the Chairman at 2:00 P. M. The minutes of the last meeting were approved as mailed. Action was taken on the following items: - Tract No. 1. - Z-1751 Applicant: U. A. Gentry Location: 124 East 24th Street Description: The East 1/2 of Lot 5, and all of Lot 6, Block 1 Fulk's Subdivision of Blocks 11E, 15 and 16, Rapley's Estate Classification: I'D"-Apartment District Variance: Requests a Variance from the Rear Yard Setback Provision of Section 43-13-(2) to permit construction in rear yard space Messrs. U. A. Gentry, applicant, and James L. Simmons, consulting engineer, were present to represent this application. Mr. Gentry explained that he wanted to build a nine unit apartment building at this location, having 77 feet on 24th Street and 144 feet on Scott Street and would like a Variance of the rear yard property line from 25 feet to 5 feet. Mr. Simmons said that garbage collection would be made from the northeast corner of the building and would be screened from the street. Individual heating and air-conditioning units would be installed in each apartment. A motion was made for approval of the Variance provided parking requirements of the City Ordinance are met, that the air-conditioning and heating units or balconies do not protrude into the side or rear yard setback, and that sidewalks are installed on LLL. R. Board of Adjustment 4th Street and Scott Street, and construct driveways 15 feet minimum width. The otion was seconded and passed unanimously. gr�ct No. 2 - Z-1522 applicant: Central Assembly of God Church olocation: 1920 Broadway Description: Lots 7, 8, 9, Block 8, Fulton's Addn. Classification: "D"-Apartment District Variance: Requests a Variance from the Rear Yard Setback Provisions of Sec. 43-13-(2) of Code of Ordinances to permit construction in rear yard space Rev, Bird H. Campbell, Pastor of the Church, was present who stated that at the present time they have two frame buildings back of the Church which will be removed to allow the Church building to be extended as far back as City's codes permit. Another frame building will also be removed and a brick structure will be built to take care of educational needs and other meetings which are now held in the frame buildings. A paved parking lot will be added which will have sixteen parking spaces. The Church also has acquired a parking lot across the street at 1915-17 Broadway and at the November 18,1963 Board of Adjustment meeting, approval was granted for this parking lot provided that there be no parking on the 25' setback from Broadway, and that it be maintained as a greenway. Mr. Bird explained that cedar trees have been ordered for this purpose but that they didn't want to set them out during the winter onths and that an adequate water supply had not been available until now to take 04are of them properly. T motion was made for approval of the Variance requested with the provision that a ompact evergreen screen having a height of not less than four feet be installed along Oth Street and Broadway Street sides to screen the parking area, and that no build- = ng permit be issued for the new construction until the Church complies with the -equirement of appropriate screening of the parking lot at 1915-17 Broadway. The motion was seconded and passed unanimously. Tract No. 3 - Z-876 4IppIicant: Longview Baptist Church I'Locati on: 1723 West 23rd Street Description: All of Lots 7, 8, 9, 10, 11 and 12 of Block 150 Fleming and Bradford Addition =)Ciassificat ion-. 1101-Two-family District 4 ariance: Requests a Variance from the Rear Yard Provisions of Section 43-12 of the Code of 0 Ordinances to permit construction in Rear M Yard Space. Mr. W. P. Nabors, Agent, was present to represent this application. There were no objectors present, although Mr. Farrell stated that he had gotten a telephone call from Mr. R. A. Walsh, who formerly lived at 1721 West 22nd Street, which is just across the alley to the north of the applicant's property. Mr. Walsh is in the hospital and wanted to'voice his objections again as he did at the November 16, 1964 meeting when this Variance was first presented. At that time, a motion was made that -3- L. R. Board of Adjustment Minutes - 1-18-65 any action be delayed until such time as the applicant filed a revised plot plan showing 22 permanent parking spaces with the grades included. The new construction would occupy the space now used for parking area, and at that time the old two- story building now being used for educational purposes, will be torn down and the area be graded down and used for parking. The alley between Mr. Walsh's property and the applicant's property is not an open alley. In ':Executive Session, a motion was made to delay Board action on this Variance request at this time, which was seconded and passed ursa_imously. Tract No. 4 - Z-1760 Applicant: M. J. Plant, Jr. Location: 3400 Asher Avenue Descriptions. Lots 1, 2, and 3, Block 2, Everett's Addn. Classification: 'IF,, -Commercial District Variance: Requests a Variance from the Use Provi- sions of Section 43-22-(4)(k) Code of Ordinances to permit wholesale business in 'IF" -Commercial zone Mr. M. J. Plant, Jr. applicant, and Mr. Leon Fields, an interested party, were present to represent this application. Mr. Fields stated that for the last 10 years this property has been occupied by the Gravely Tractor Agency who sold and serviced tractors. Mr. Plant also owns the two adjoining lots at 3404 and 3408 Asher Avenue, one of which is vacant. Across the street is an "I" -Light Industrial operation and a junk yard. The applicant wishes to put in a wholesale and retail electric supply company. There will be no stored materials outside of the building and it is his opinion that there won't be as much traffic in connection with the operation of this business as there was in connection with the operation of the present tractor company. Parking could be taken care of on the vacant lot. The metal building on the site would be used for the storage of materials and an electric shop. A motion was made that the application be approved for Lot 1 only, withth a provision that the owner provide curb and gutter and sidewalks along Asher Avenue on Lot 1; and curb and gutter along Martin Street to extend from Asher Avenue back to the front of the building; that the parking lot must meet the approval of the Staff; and that there be no open storage. The motion was seconded and passed unanimously. Tract No. 5 - Withheld Tract No. 6 - Withdrawn Tract No. 7 - Z-1614 Ppplicant: Donald Kirk Location: 8020 West Markham Street Description: Long Legal Classification: "D"-Apartment District Variance: Requests a Variance from the Rear Yard Setback Provisions of Section 43-13-(2) of the Code of Ordinances to permit construction in Rear Yard Space, and a Variance from the Main Structure Provi- sions of Section 43-2-(5) of Code of Ordinances to permit more than one main structure on a lot. Mr. Donald Kirk, applicant, and Mrs. Roy W. Jacobi, of Russellville, who owns adjacent property, were present. Mrs. Jacobi stated that she was offering no objection, but did want action delayed until they could investigate certain aspects of the develop- -4- Board of Adjustment Minutes - 1-18-65 ment, as they did not get the notice until several days ago. Mr. Kirk is requesting a Variance of 10 feet in the rear yard space as he stated he wanted to set the apart- ment buildings back off of Markham Street as much as possible, assuming that this street would eventually be widened. The present layout has a 27 foot setback from Markham Street. Mrs. Jacobi stated that there is a drainage problem at this location and she wants to do some checking to determine what effect this building would have on her property. Mr. Kirk suggested that the City Engineer should be consulted to get his opinion as to the possibility of controlling the drainage problem with larger culverts, etc. A motion was made that action be deferred until the February meeting in accordance with Mrs. Jacobi's request, and that in the meantime Mr. Kirk make a decision as to whether he would rather eliminate that part of the structure on the rear to be used fo:- storage, or move the buildings forward 5 feet. The motion was seconded and passed unanimously. Tract No. 8 - Z-868 Applicant: Harry M. Booe Location: 8515 West Markham Street Description: Long Legal Classification: 'IF', -Commercial District Variance: Requests a Variance from the Main Structure Provisions of Section 43-2-(5) of Code of Ordinances to permit more than one main structure on a lot. Mr. Booe was present to represent this application for Variance, and stated that he would like to build a grocery store on this property; that he will tear down one building on the west side and retain the other small building as an accounting office. Mr. Lofton Lewis, representing Brady Lodge, said that they were not objecting unless the adjacent property owners were in opposition. A motion was made for approval of the Variance requested provided curb and gutter and sidewalks for a 48' pavement across the entire tract, ir+cluding existing office building, be constructed, and that additional dedication for West Markham Street to comply with the master Street Plan be dedicated, and that the driveway and parking both for the store and office building meets with the City's requirements; and that the old frame structure and well -house be removed. The motion was seconded and passed unanimously. Tract No. 9 - Z-1392 Applicant: Wm. and Janie Bushman Location: 2400 Manney Streets Description: Lots 13, 14, 15, 16 of Block 13, Bellevue Addition Classification: "D"-Apartment District Variance: Requests a Variance (1) from the Rear 43-13-(2) Yard Provisions of Section of the Code of Ordinances to permit construct- ion in Rear Yard Space, (2) from the Front Yard Provisions of Section 43-13-(4) of Code of Ordinances to permit construction in Front Yard Space, (3) from the Provi- sions of Section 43-21-(H)(6) of Code of Ordinances to permit parking in Front Yard Space. -5- Board of Adjustment Minutes - 1-18-65 Mr. Lawrence Witherspoon, representing the applicant, William A. and Janie Bushman, was present. he stated that there is enough area to build 37 apartment units on this property, but that the applicant intends to spread the buildings out so that each unit opens on to the grade, and that there is quite a distance from other property owners, and that there is a 20 foot dedicated alley. Instead of the 37 units that is allowed on this size area, they are going to build only 33 with plenty of parking space which he thinks would be a far more attractive layout both from the neighbors point of view and the applicant's. This piece of property has extremely rough terrain. and characteristics and is not suitable for residential use and consequently was zoned "D"-Apartment several years Ago. The construction will be brick veneer and frame, and protective screening and planting will be used around the property. There were several adjacent property owners present to voice their opposi- tion, among whom were Mr. and Mrs. Donald Jones, 849 WhiteOak Lane; Mr. Larry Cross- land, #53 4%fiite Oak Lane; Mrs. Vernon Ward, 132 Indian Trail, all of whom were concerned about having a large apartment building in close proximity to their property, and the drainage problems which would result, in their opinion. Mr. Moritz Shollmier, #45 White Oak Lane also was present and said that he had not been notified of the Zoning Variance which had been filed. (The abstractor's list of property owners does not show Mr.,Shollmier as a property owner to be notified.) Mr. Sam Reynolds, representing the developer of a subdivision to the north who still owns two lots within the 140 foot limit of this property, said he was not protesting nor advocating the Variance, but did not want the drainage problem on these two lots to be aggravated. Mr. W. F. Howell, 135 Indian Trail wanted to know about parking spaces and also the drainage situation. A motion was made in Executive Session that the application for Variance be denied. The motion was seconded and passed unanimously. By acclamation, Mr. Scott Farrell was elected Chairman for 1965, and Mr. W. R. Meeks, Vice Chairman.
