"A" One -family District Variance: Requests a variance from the rear yard provisions of Sec. 43-12 of the Code of Ordinances to permit encroach- ment into rear yard setback BOARD ACTION: THE BOARD VOTED TO APPROVE THE VARIANCE AS REQUESTED. (4 ayes - 0 noes - 1 absent) Staff Recommendation: This request was presented to the Board of Adjustment previously on Aug. 17, 1970, at which time it was denied. The staff recommends approval of the application as we feel the house actually shares two side yard relationships and if the house had faced Beechwood, as the lot is platted this would be the normal side yard. We have letters from property owners to the south and east indicating no objec- tion to this request. Present Classification: "I" Light Industrial District Variance: Requests a variance from the use provisions of Sec. 43-22(d) of the Code of Ord. to permit parking, access and loading in a residential zone Requests a variance from the previous Board of Adjustment action BOARD ACTION: THE BOARD VOTED TO WITHDRAW THIS APPLICATION AT THE REQUEST OF THE OWNER. (5 ayes - 0 noes - 0 absent) Staff Recommendation: Subject property is the south 1/2 of a larger parcel which on Sept. 1070 was rezoned to "F" Com- mercial on the north 1/2 and "D" Apartment on this, the south 1/2. In March 1973, the property was subdivided with the intention of developing the two tracts separately. At the same time, the north 1/2 was reclassified "I" Light Industrial. The apartment proposal on subject property ran into problems and in Oct. 1973 was rezoned "I" Light Industrial with the south 50 ft. being dezoned to "A" One -family as a buffer. The owner, wishing to recombine both tracts for an office -ware- house park, applied in Nov. 1973 to the Board of Adjustment to obtain permission to utilize the 50 ft, strip of "A" zoned property for access, parking and drives; This request was approved subject to: a) The 50 ft. strip of land under consideration was not rezoned with the remainder of the tract in an effort to retain the natural growth as a screen against the resi- dential properties to the south. If this area is to be used for parking, a survey locating all trees within this area larger than 6 in. in diameter should be provided and. the parking and drives should be so arranged as to retain 2 - 10-27-75 Item No. 2 - Z-2382-C (Continued all of those trees. b) Applicant to provide the staff with a detailed site development plan showing the area of office and ware- house uses, and dimensions of all parking areas and stalls. All drives, turning radii, etc. to meet Industrial Subdivision regulations. c) All parking and drive areas to be paved and landscaped as required by the zoning.ordinance. A 6 ft. opaque wooden`or masonry screen is to be installed and main- tained where parking and drive areas abut residential zoned properties. d) No access to Woodson Rd. to be permitted. At this time, the applicant wishes to again separate the two tracts. This application is a request to utilize the 50 ft. "A" zoned strip for drives, access parking and loading. The staff recommends that the previous conditions (a),(b) and (c) remain as before with condition (d) to be changed to allow truck traffic access at the northwest corner of subject lot while restricting access and parking in the 50 ft. "A" zoned strip to automobiles only. - 3 - 10-27-75 Item No. 3 Case Number: Applicant: Location: Z-2760-B Herbert Stortz 2801 Foxcroft Description: Long legal Present Classification: "MF 24" Multi -family District Variance: Requests a variance from the side yard provisions of Sec. 43-13- (3) of the Code of Ord. to permit encroach- ment into side yard BOARD ,ACTION: THE BOARD VOTED TO APPROVE THIS REQUEST SUBJECT TO THE APPLICANT PROVIDING A VISUAL SCREEN SEPARATING SUBJECT PROPERTY FROM THE ADJACENT PROPERTY TO THE EAST. (5 ayes - 0 noes - 0 absent) Staff Recaminendation: The staff feels that the proposed walkway will not be sufficiently visable to adversely affect adjacent properties. The building_.permit section has been consulted on the proposal and they indicate no objection. We feel that the partition proposed between the walk structure and patios would create an effective visual separation. The owner has informed the staff that he has received letters from the utility companies indicating they are not in opposition. Therefore, we recommend approval of this request as submitted. There were three objectors present. Two letters of objection received. - 4 - 1- 27-75 Item No. 4 Case Number: Z-2951 Applicant: Louis Kelly of Ark. Orchestra Society Location: 1821 Broadway Description: Lot 4 and N 20 ft. of Lot 5, Block 2, Fulton's Addition Present Classification: "E-l" Quiet Business District Variance: Requests a variance from the use provisions of Sec. 43-22 (4)(c) of the Code of Ord. to permit "Symphony Designer House" (temporary Committee use) BOARD ACTION: THE BOARD VOTED TO APPROVE THIS APPLICATION AS REQUESTED. (5 ayes - 0 noes - 0 absent) Staff Recommendation: On Oct. 1974, the Board of Adjustment determined through a previous request that they do have jurisdiction to permit a temporary retail sales use in a residential zone citing Sec. 43-22(4)(d) of the Code of Ordinances dealing with uses of a philanthropic nature. (the previous case was of the same nature as this proposal; that is, a Symphony Designer House) The staff therefore recommends approval of this request for a period of 3 weeks (April 22 - May 17, 1976) subject to signage be in compliance with the Sign Ordinance of the City of Little Rock. In addition, any signage be permanently removed on or before May 17, 1976, at which time relinquish- ing all claim to any further suspension of the existing zoning restrictions. Coulter Location: 1718 South Grant Description: S48 ft. of Lots 13 and 14, Block 9, Bateman's Addn. Present Classification: "A" One -family District Variance: Requests a variance from the rear yard setback provisions of Sec. 43-12 (2) of the Code of Ord. to permit encroachment into rear yard BOARD ACTION: THE BOARD VOTED TO APPROVE THIS REQUEST AS SUBMITTED. (5 ayes - 0 noes - 0 absent) Staff Recommendation: This request is for a 16' x 20' addition which would encroach 7.5' _+ into the required 25' rear yard setback. The staff recommends approval as there are no residential structures to the west of subject property due to Coleman Creek. The development further west is commercial and oriented to University Avenue. There were no objectors present. - 6 - 10-27-75 Item No. 6 Case Number: Z-2957 Applicant: Dr. William Cooper Location: 51 Edgehill Description: Part of Lots 49 and 51, Edgehill Addition Present Classification: "A" One -family District Variance: Requests a variance from the side yard setback provisions of Sec. 43-12 (3) of the Code of Ord. to permit encroachment into side yard BOARD ACTION: THE BOARD VOTED TO APPROVE THIS REQUEST AS SUBMITTED. (4 ayes - 1 no - 0 absent) Staff Recommendation: The staff feels that there is adequate ope:•i space in the rear yard of subject property to provide for the required 8 ft. side yard setback and the pool with canopy. We feel the proposed 2 ft. setback would not allow sufficient circulation around the lot and therefore recom- mend denial of this request as submitted. There were no objectors present. - 7 - 10-27-75 Item No. 7 Case Number: Applicant: Location: Description: Present Classification: Z-2961 Dr. Irving Kupperman 5912 Scenic Drive Lot B, Block 3, East Palisades Addition "A" One -family District Variance: Requests a variance from the rear yard setback provisions of Sec. 43-12 (2) of the Code of Ord. to permit encroachment into rear yard setback BOARD ACTION: THE BOARD VOTED TO APPROVE THIS APPLICATION AS REQUESTED. (5 ayes - 0 noes - 0 absent) Staff Recommendation: This request is for permission to construct an addition onto the rear of a residence which will encroach 9 ft. into the required 25 ft. rear yard set- back. The staff recommends approval of this application as we feel there is an adequate amount -of screening and remain- ing rear yard space to allow the request. There were no objectors present.
