Godwin Item No. 1 - NEW MATTERS Case Number: Z-2926-A Applicant: Coulson Oil Company Location: 8100 West Markham Description: Long legal Present Classification: "A" One -family District Variance: Requests a variance from the front yard provisions of Sec. 43-12(4) of the Code of Ordinances to permit encroachment of canopy into front yard setback Requests permission under the pro- visions of Sec. 43-22(4)(b) of the Code of Ordinances to permit expansion of a nonconforming use BOARD OF ADTUSTMENT ACTION: THE BOARD VOTED TO APPROVE THE REQUEST AS RECOMMENDED BY THE STAFF. (3 ayes - 0 noes - 2 absent) Staff Recommendation: This item is referred to the Board by the Planning Commission as a result of a rezoning application. The applicant proposed to rezone this long standing noncon- forming service station in order to expand its retail operation to car wash, grocery, etc. The staff recommended the Board of Adjustment route in order to allow the applicant the flexi- bility he needs in development and at the same time not extend the commercial zoning further east along Markham Street. The staff would recommend approval of the proposed 15' x 28' wash bay as an expansion of this nonconforming use. We further recommend approval of the canopy subject to it not being closer than 13' from the front property line. This would necessitate either moving the canopy structure nine additional feet to the north or eliminating that 9 ft. of overhang between the pump island and Markham Street. There were no objectors present. The owner was present and represented by Barry Church, Attorney. - 1 - Item No. 2 - NEW MATTERS Case Number: Applicant: Location: Description: Z-2931 John Roberts 7209 Rockwood Road Lot 298, Kingwood Place Addition Present Classification: "A" One -family District Variance: Requests a variance from the rear yard provisions of Section 43-12(2) of the Code of Ordinances to permit encroachment into rear yard set- back Requests permission under the provisions of Sec. 43-22(4)(b) of the Code of Ordinances to permit expansion of a noncon- forming structure BOARD OF ADJUSTMENT ACTION: THE BOARD VOTED TO APPROVE THE REQUEST AS FILED. (3 ayes - 0 noes - 2 absent) Staff Recommendation: The staff feels that the proposed addi- tion will have no effect on.adjacent properties. The existing structure is nonconforming due to the rear yard relationship and this request will not increase that nonconformity. We recommend approval as submitted. There were no objectors present. The owner was represented by D. May of Howe, Inc. - 2 - Item No. 3 - NEW MATTERS Case Number: Applicant: Location: Z-2932 Ray Hurt 4600 Sunny Hill Court Description: Lot 2, Seals Subdivision Present Classification: "A" One -family District Variance: Requests a variance from the rear yard provisions of Sec. 43-12 (2) of the Code of Ordinances to permit encroach- ment into rear yard setback BOARD OF ADJUSTMENT ACTION: THE BOARD VOTED TO APPROVE THE REQUEST AS FILED. (3 ayes - 0 noes - 2 absent) Staff Recommendation: The staff recommends approval as requested as there is sufficient separation between structures to allow this addition. In most corner lot developments the structure involved shares two side yard relationships. We do not see this as being a significant problem. There were no objectors present. The owner was present. - 3 - Item No. 4 - NEW MATTERS Case Number: Z-2938 Applicant: Ms. John Parker Location: #18 Avon Place Description: Lot 18, Parkway Addition Variance: Requests a variance from the side yard provisions of Sec. 43-12(3) of the Code of Ordi- nances to permit encroachment into side yard setback BOARD OF ADJUSTMENT ACTION: THE BOARD VOTED TO DENY THE REQUEST AS FILED AND APPROVED A 5 FOOT SIDE YARD SETBACK ON THE NORTH. (3 ayes - 0 noes - 2 absent) Staff Recommendation: The staff recommends approval of the addition to the west as it will not significantly increase the nonconformity of the south side yard setback but recommends denial of any encroachment into the north side yard setback. We feel that if the required 6 ft. setback were provided on the north side the remaining 14'-6" would be adequate for a carport or garage. If additional spaces are desired we recommend placing them in the rear yard. There were no objectors present. The applicant was present.
