City Attorney present: Riddick Riffel NEW MATTERS Item No. 1 Case Number; Z-2912 Applicant: Donald J. Jones Location: 7010k Grace Road Description: Lot 14, Graceland Acres Addition Present Classification: "A" One -family District Variance: Requests a variance from the Use Provisions of Section 43-22 (4) of the Code of Ordinances to permit addition to a nonconforming structure BOARD OF ADJUSTMENT ACTION: THE BOARD VOTED TO APPROVE THE VARIANCE AS REQUESTED. ( 5 ayes - 0 noes - 0 absent) Staff Recommendation: The staff feels that this addition would not adversely affect adjacent buildings or property. The structures on this lot were existing when annexed and this addition would not be a significant change to the area. Therefore, we recommend approval of this applica- tion as requested. The applicant was present. There were no objectors present. - 1 - I Case Number: Z-2917 Applicant: Robert Purefoy Location: 121 Thayer Street Description: Lot 11, Block 4, Capitol View Addition Present Classification: "B" Residence District Variance: Requests a variance from the Yard Setback Provisions of Sec. 43-12 of the Code of Ordinances to permit encroach- ment into front and side yard setbacks BOARD OF ADJ-UST�WRT ACTION: THE BOARD VOTED TO DENY THE VARIANCE AS REQUESTED. (5 ayes - 0 noes - 0 absent) Staff Recommendation: The front yard setbacks north and south from this lot are consistent at 30 ft. and two or three have 10 ft. porches. There is no structure on this street closer to the property line than the one in this application. The staff would recommend that the proposal be denied and that the applicant extend the existing slab and place the carport in the side yard 30 ft, from the front prop- erty line, or grade the slope and place the carport in the rear yard. The applicant was present. There were no objectors present. - 2 - T +- -- TT^ 14 Case Number: Z-2918 Applicant: Richard Yarborough Location: 421 and 423 East 15th Description: East 75 ft. of Lot 12, Block 53, Original City Present Classification: "F" Commercial District Variance:" Requests a variance from the Yard Setback Provisions of Sec. 43-15 of the Code of Ordinances to permit con - structure of duplex with yard encroachments BOARD OF ADJUSTMENT ACTION: THE BOARD VOTED TO APPROVE THE VARIANCE AS REQUESTED. ( 5 ayes - 0 noes - 0 absent) Staff Recommendation: The proposed duplex replaces a commercial structure which existed on the site for many years. That structure provided no setbacks from either street. The proposed 15 ft. setback from Commerce St. would be consistent with the structures in the rest of the block and the 15 ft. from East 15th Street would be further back than the existing structure to the west which sits on the lot line. The staff's principle con- cern was circulation and access for emergency vehicles. The Fire Chief has indicated no problem with the 5 ft. interior separation. Therefore, the staff recommends approval as requested. The applicant was present. There were no objectors present. - 3 - DEFERRED MATTERS T+-- W- A Case Number: Z-2579 Applicant: B.C. Corp. and Fairmont, Inc. Location: 724 Bishop Street Description: E2 of Lots 7 and 8 and all of the E 125 ft. of Lot 9, Block 12, Fausts Addition Present Classification: "D" Apartment District Variance: Requests consideration of previous variance request for parking lot in residential district, Sec. 43-22 (0) BOARD OF ADJUSTMENT ACTION: THE BOARD VOTED TO DEFER THE CASE FOR AN ADDITIONAL YEAR - APRIL 1976 meeting. ( 5 ayes - 0 noes - 0 absent) Staff Recommendation: This application was originally filed in 1972 as the result of a zoning violation investigation. The property lies within the Mills Freeway right-of-way. At its meetings in April of 72, 73 and 74, the Board deferred any action on the issue for a period of one year. The owner was advised he would not have to comply with ordi- nance requirements. The State Highway Dept. has again been notified of the recurrence of this application and they reply no disposition of the property has been made. Therefore, the staff recommends an additional one year deferral of the issue. There was no one present to represent the applicant. There were no objectors present. - 4 - OTHER MATTERS Item No. 5 Case Number: Z-1668-A Applicant: Capitol City Motors Location• 6706 South University Description: Long legal Present Classification: "F" Commercial District Requests permission to address the Board of Adjustment with reference to the screening previously required. Staff Recommendation: The staff will present recom- mendation on this issue at hearing. Mr. Haney was present at the meeting and was advised by the Board that they did not desire to deal with the issue and that the Board does not consider chain link to be of residential charactor: the Board stated that in the past chain link has not been acceptable as screen- ing and they have required wood fences be placed in these relationships (residential against business).
