Godwin NF.W MATTERS T+-mtn Wn _ 1 Case Number: Z-1859-E Applicant: Union National Bank Location: 1500 Block North University Description: Long legal Present Classification: "E-1" Quiet Business District Variance: Requests a variance from the Sign Area Provisions of Sec. 43-6(9) of the Code of Ord. to permit sign in excess of permitted area BOARD OF ADJUSTMENT ACTION: A MOTION WAS MADE FOR APPROVAL OF VARIANCE SUBJECT TO RECORDING IN THE MINUTES A SPECIFIC NOTE THAT THE APPLICANT WOULD NOT BE ALLOWED ANY ADDITIONAL SIGNS ON THE SITE IF THIS IS APPROVED. THE MOTION WAS SECONDED BUT FAILED TO RECEIVE THE REQUIRED 3 AFFIRMATIVE VOTES. THE REQUEST WAS THEREFORE DENIED. (1 aye - 2 noes - 1 absent) The Chairman did not vote. Staff Recommendation: This request is a continuation of the effort of Union National Bank tolocate a free standing sign on this site. This tract is presently zoned "E-1", which district permits a maximum of 8 sq. ft. of signing at present. This limitation on area prompted a variance request in June, 1974 for a pole sign of +69 sq. ft. That variance request included a building mounted sign of 62 sq. ft. The Board at that time denied the pole sign and approved the building mounted sign even though the pole sign was in con- formance with the proposed sign ordinance. The application returns to the Board with this request which is for a ground mounted sign only. The proposed sign has two faces but one orientation. The new Sign Ord. (which is at this time not in force) would under the definition of sign area, permit +77 sq. ft. in the fashion -proposed. The appli- cant now proposes +79.6 sq, ft., at 6' high, this based on the horizontal dimiension being 22'-9" on the plane of vision that presents the largest area. The staff supported the previous request as it was in line with the new code and we feel we can support this request, somewhat modified. The height of the proposed sign structure is 6 ft. which we feel is compatible with the existing wall and development along University Ave. We would recommend that - 2 - Item No.l- Z-1859-E (Continued) the variance be granted and that the sign incorporate a horizontal dimension of 22 ft., dropping the 9 inches, this will bring the area as close as possible to the new code. (It is planned to start administration of the new ordinance by May 12, 1975.) The staff would further recommend that the sign be located so as not to intrude into the 50' sight triangle required by the Traffic Code and possibly make the sign part of the existing wall. There were no letters of objection. Where were objectors present represented by Mrs. Jo Kimmins. Mr. Charles Maynard was present representing the bank. - 3 - Item No. 2 Case Number: Applicant: Location: Description: Present Classification: Z-2901 Ark. Farm Bureau Federation 701 High Street Long legal "E-1" Quiet Business District Variance: Requests a variance from the Yard Area provisions of Sec. 43-14 (3) & (4) of the Code of Ord. to permit en- croachments into 2 yard setbacks Requests a variance from the Height provisions of Sec. 43-14 (1) of the Code of Ord. to permit height in excess of 45' BOARD OF ADJUSTMENT ACTION: THE BOARD VOTED TO APPROVE THE VARIANCE REQUEST AS MODIFIED: THAT INCLUDES DELETING ONE OF THE 3 UNDERGROUND PARKING LEVELS AND ALIGNING THE BUILDING WITH 21' SETBACK FROM 7TH STREET RIGHT-OF-WAY. (4 ayes - 0 noes - 1 absent) Staff Recommendation: This application involves the con- struction of a new building and the attachment to the existing Ark. Farm Bureau Federation Bldg. across High Street. It should be noted that the Board of Directors has already approved the franchise for construction over High Street right-of-way. This construction will elimi- nate the existing parking.lot and place it underground on 3 levels. .The staff finds no objection to the height and side yard waivers and would recommend approval of these!as submitted. We do recommend, however, that the front yard be maintained at 20' aligning the new with the existing structure. This recommendation is based on the possibility of additional right-of-way tieing taken off of 7th Street to serve this development -and the relocated High Street/7th Street intersection. There were no objectors present. The application was represented by Howard Cockrill. -4- Item No. 3 Case Number: Z-2902 Applicant: Griffin -Leggett, Inc. Location: 5800 West 12th Street Description: W'k, SE'k, SW'k, SWk, Sec. 6, T-1-N, R-12-W Present Classification: "E-1-A" Nursing, Lodging, Undertaking District Variance: Requests a variance from the Screening provisions of Sec. 43-6-of the Code of Ord. to permit deletion of screen- ing requirement BOARD OF ADJUSTMENT ACTION: THE BOARD VOTED TO APPROVE THE VARIANCE AS REQUESTED. (4 ayes - 0 noes - 1 absent) Staff Recommendation: This application requests the elimination of the 4 ft.. opaque screening requirement around parking areas. Inspection of this site led the staff to a.recommendation of approval due to the fact that Coleman Creek and the cemetery do not necessitate a.physical buffer and second, the residences to the south are _+ 6 ft. below grade of this site, as well as the street. There were no objectors present. The Applicant's representative was present. - 5 - T f- am Mn _ It Case Number: Z-2903 Applicant: Greater 2nd Baptist Church Location: 2818 High Street Description: NZ of Lot 8 and all of Lot 9, Block 23, Braddock's Blvd. Addition Present Classification: "C" Two-family District Variance: Requests a variance from the Use provisions of Sec. 43-22 (4)(D) of the Code of Ord. to permit parking lot in con- junction with church Requests a variance from Front Yard Open Space provisions of Sec. 43-20 (2 M of the Code of Ord. to permit parking in the front 25 ft. of a resi- dential zone BOARD OF ADJUSTMENT ACTION: THE BOARD, BEFORE DEALING WITH THIS CASE, WAS ADVISED THAT THE OWNER COULD NOT BE PRESENT BUT THAT HE HAD ASKED FOR CONSIDERATION TODAY ANYWAY. THE BOARD VOTED TO DEAL WITH THE ISSUE, AND THEY VOTED TO RE MMEND APPROVAL OF THE VARIANCE SUBJECT TO: 1. The owner contracting the installation of these improvements along with those improvements previously involved in the building permit, and accomplish them all at one time. 2. The front yard green space to be established in line with the house on the south, and the green area protected by inner curb on parking area. 3. The protection of the large tree on the south property line through any means necessary. 4. Drainage plan on this site to be reviewed by the Public Works Dept. There were no objectors present. There was one interested person present (an adjacent property owner). - 6 - Item No. 4 - Z-2903 Continued Staff Recommendation: This application involves parking in conjunction with a church located in a residential zone. The church is located +50 ft. to the south and on the east side ❑f High Street. The property in question had a residence on it but it has been removed. Detached parking lots in residential zones are not uses by right. The staff recommends approval of this application subject t❑ the east 25 ft. being landscaped and maintained as green space and the required 4 ft. opaque screening be provided around the perimeter of the paved area.
