Roll Call and Finding of a Quorum A Quorum was present being seven in number. Approval of the Minutes of the Previous Meeting. The Minutes were approved as mailed out. III. Staff does not know whether a building permit was obtained prior to construction or not. The carport no doubt projects into the public right-of-way, as well as across the entire front yard setback. The hardship in this case is probably totally associated with economics, in that the owner has probably paid for this carport and would have little recourse against the contractor. Staff cannot support this application, even though it would have supported an application for a carport of approximately one half this length for either one or two cars. Staff recommends denial. BOARD ACTION: The applicant was present, and there were no objectors. There was a lengthy discussion of the various alternatives available, from complete removal of the structure to various partial approvals of its location. Finally, after all of the various choices had been examined, the Board moved to approve the 25' front yard encroachment with the provision that no enclosure of the structure be permitted in the future. The motion was passed: 4 ayes, 2 noes and 1 abstention (George Wells abstained). January 18, 1982 Item No. 2 - Z-3792 Owner: Borden Foods Company By H.E. Windham Address: 5800 Frozen Road Description: Long Legal Zoned: "I-2" Light Industrial Variance Requested: Relief from Section 7-104.2 to permit a 10' side yard on the east side for a warehouse addition Present Use of Property: Industrial Proposed Use of Property: Same STAFF RECOMMENDATION: The proposal is to construct an addition onto the easterly front portion of the existing warehouse building. The proposed addition will project forward approximately 80' paralleling the east property line and the fence now in place. When the original building was constructed, the Zoning Ordinance did not require any side yard setbacks in this district. The proposed development does not increase the nonconformity imposed by the present ordinance. Therefore, Staff favors the requested variance. Staff recommends approval. BOARD ACTION: The applicant was present, and there were no objectors. The applicant stated that this was going to be a refrigerated warehouse addition, and that its addition was dictated by existing circumstances. After a brief discussion, the Board moved to approve the application as filed, and the motion was passed: 7 ayes and 0 noes. January 18, 1982 Item No. 3 - Z-3795 Owner: Address: Description: Zoned: Variance Requested: Ralph Stiefvater 35 West Windsor Drive Long Legal "R-2" Single Family Relief from Section 7-101.2d to permit a 3' side yard for an addition Present Use of Property: Single Family Proposed Use of Property: Same �mT T'l"1 TT/'l1TRTR TTITTTT/lTl . The applicant proposes an addition to this home, which sets upon an unusually configured lot. There is a severe vertical drop between this property and the property to the west and south. There appear to be no structural conflicts with any adjacent property. Staff recommends approval. BOARD ACTION: The applicant was present, and there were no objectors. After a brief discussion, the Board moved to approve the application as filed. The motion was passed: 7 ayes, 0 noes. January 18, 1982 Item No. 4 - Z-3797 Owner: Address: Description: Zoned: Variance Requested: Present Use of Property: Proposed Use of Property: Real Properties, Inc. By Richard Savage Park Plaza Shopping Center, Markham and University Long Legal "C-3" General Commercial Relief from Section 7-103.3c to permit a 54' height limitation for a clock tower. Shopping Center Same STAFF RECOMMENDATION: The proposed clock tower is connected with an overall facade renovation proposed for the Park Plaza Shopping Center. The clock tower is designed to provide a focal point for the center, and will be located well within the existing central walkway system of the shopping center. This will be some 55' north of the existing Markham Street facade of the shopping center. Staff recommends approval. BOARD ACTION: The applicant was present, and there were no objectors. After a brief discussion, the Board moved to approve the application as filed. The motion was passed: 6 ayes, 0 noes and 1 abstention (George Wells abstained). January 18, 1982 Item No. 5 - Z-3787 Owner: W.C. McMinn Address: 5501 Country Club Description: Lot 1, Block 21, Newton Addition Zoned: "R-2" Single Family Variance Requested: Relief from Section 7-101.2d to waive the 5' side yard setback requirement on the west side, and to permit a two-story attached garage Present Use of Property: Single Family Proposed Use of Property: Same STAFF RECOMMENDATION: All streets in this area have 80' rights -of -way, and this addition will be approximately 25' from the street. Staff recommends approval. BOARD ACTION: The applicant was present, and there were no objectors. After a brief discussion, the Board moved to approve the application as filed.
