II. Approval of the Minutes of the Previous Meeting. Minutes of the previous meeting were approved as mailed out. III. Members Present: Members Absent: Richard Yada, Joe Norcross B.L. Murphree George Wells Jim Summerlin Ellis Walton (one vacancy) Attorney Present: None Vice -Chairman The February 16 meeting was actually held on February 22, 1982, because a Quorum could not be present on the originally scheduled date. February 16, 1982 Item No. 1 - Z-3800 Owner: James H. Jones Address: 11900 Pleasant Tree Drive Description: Lot 21, Pleasant Tree 3rd Addition Zoned: "R-2" Single Family Variance Requested: Relief from Section 7-101.2d to permit a 13-foot rear yard. Present Use of Property: Single Family Proposed Use of Property: Single Family STAFF RECOMMENDATION: This proposal, like so many others seen in the past several months, deals with the problem which arises out of having two platted "front yard" setbacks of 25 feet. The Ordinance amendment mentioned so many times in the past will finally go to the Planning Commission this month. The amendment proposes that rear yards be permitted a reduction to eight feet under the two front yard situation associated with corner lots in newly platted subdivisions. The staff recommends approval. BOARD ACTION: The applicant was present, and there were no objectors, and after a brief discussion, the Board moved to approve the application as filed. The motion was passed - 4 ayes, 0 noes, 2 absent and 1 vacancy. February 16, 1982 Item No. 2 - Z-3802 Owner: Brooks Rosen By: Kenneth Holmes Address: 6200 Cantrell Description: Long Legal Zoned: "R-2" Single Family Variance Requested: Relief from Section 7-101.2d to permit a 17-foot rear yard setback. Present Use of Property: Single Family Proposed Use of Property: Single Family STAFF RECOMMENDATION: This lot shows a truly unique circumstance having street frontages on three sides and a relative shallow depth from south to north. The proposal will result in a rear yard encroachment of eight feet. This too would fall under the same criteria as discussed in earlier cases even though no platted setbacks are established on this lot. Staff recommends approval. BOARD ACTION: The applicant was present, and there were no objectors, and after a brief discussion, the Board moved to approve the application as filed. The motion was passed - 4 ayes, 0 noes, 2 absent, 1 vacancy. February 16, 1982 Item No. 3 - Z-3803 Owner: Gary and Debbie Brice Address: 9507 Woodford Drive Description: Lot 72, Merrivale Addition Zoned: "R-3" Single Family Variance Requested: Relief from Section 5-101.F2c to permit coverage of rear yard in excess of 30 percent. Present Use of Property: Single Family Proposed Use of Property: Single Family STAFF RECOMMENDATION: The Ordinance permits a maximum coverage of 30 percent of the rear yard (that is, the rear yard required by Ordinance). This property backs up to the Missouri Railroad mainline track, removing any concerns for neighboring property relationships. The proposed structure would cover approximately 41 percent of the required yard space and will be located nearly 40 feet from the main structure. Staff recommends approval. BOARD ACTION: The applicant was present, and there were no objectors, and after a brief discussion, the Board moved to approve the application as filed. The motion was passed - 4 ayes, 0 noes, 2 absent, 1 vacancy. February 16, 1982 Item No. 4 - Other Matters We presently have two ordinance interpretation matters, one dealing with the Green Tree Nursery located at 9305 Rodney Parham Road and the second dealing with Griffin Leggett Healey and Roth Funeral Home located at 5800 W. 12th Street. In each of these cases, the Board is asked to make determinations as to the meaning and intent of the Zoning Ordinance. These matters were discussed briefly in a memorandum from the Zoning Administrator, and the Board should be aware of it at this time. BOARD ACTION: Re: Green Tree Nursery Interpretation There was a lengthy discussion of the various aspects of this conditional use amendment question. The owner of Green Tree Nursery and his attorney spoke for quite sometime to the Board about what was being proposed. The Board asked a number of questions, and finally having taken a very close look at the paragraph in the Ordinance in question, the Board moved to interpret Section 4-102H of the Zoning Ordinance such that a structural addition is not an amendment or change -to a conditional use authorization as specified in the Ordinance. That motion passed - 4 ayes, 0 noes, 2 absent, 1 vacancy. In connection with this interpretation, the Board expressed its concern that this would be a far-reaching interpretation which would have long-term effects and instructed Vice -Chairman Richard Yada to write a letter to Dr. Robert Wright, Chairman of the Little Rock Planning Commission expressing its concern and suggesting that the Planning Commission consider making the appropriate amendments to Section 4-102H so that this "loophole" could be closed. Re: Griffin Leggett Healey and Roth Funeral Home Interpretation The Board discussed the various issues involved, acknowledged that cemetery monument sales are not listed as a use and determined that this operation is compatible with the normal funeral home operation and interpreted the Ordinance such that cemetery monument sales are permitted in the "C-3" General Commercial District and/or in connection with a funeral operation on the same site.
