Murphree Ellis Walton George Wells Member Absent: Marcelline Giroir I Vacancy December 20, 1982 Item No. 1 - Z-3509-A Owner: Ralph Irwin By: Rick Freeling Address: 11711 West Markham Street Description: Long legal Zoned: "C-3" General Commercial Requested: Relief from Chapter 38.3 of the Code of Ordinances to permit a broadcasting tower 45 feet higher than permitted by Ordinance. Present Use of Property: Carpet Sales (vacant) Proposed Use of Property: Television Broadcast Studio STAFF RECOMMENDATION: The applicant represents the operators of the Channel 16 television broadcasting station which is planning to locate at this site. The station requires a tower with which to transfer originating signals from the station to its primary broadcast tower on Shinall Mountain. Total tower height will 10-e 120 feet, and J;,.- will bie 'Located as shown on IChe graphic. Staff recommends approval. BOARD ACTION: The applicant was present, and there were two objectors present. Barbara Oberste, 200 Alaimo, spoke for the opponents. She showed photographs of the site of the proposed tower, as well as of the neighborhood generally. In addition, she presented the Board with a petition containing 44 signatures in opposition to the request. T, opposition centered around safety factors relative to win damage, to the tower being a potential nuisance to child safety and to aesthetic values. I After the opponents presented their side of the case, the applicant answered several questions relative to the project and stated in answer to some of the questions that around $800,000 for improvements to the site and building were planned as a part of the development. Further, in answer to the nuisance and safety factors, he stated that the tower was designed to withstand 150 mile per hour winds with December 20, 1982 Item No. 1 - Continued 1/2" of ice on the tower, as well as that there would be a chain link fence around the tower with barbed wire on top in order to keep people off the tower. There was a lengthy discussion of various alternative plans to locate the tower differently or to use other methods to provide the same technical effect to the TV station. After the discussion, the Board moved to deny the application. The motion passed: 5 ayes, 0 noes, .1 absent and 1 vacancy. This application was denied. December 20, 1982 Description: Variance Requested: Flintkote Building Products Company By: James I. Byrd 2701 E. Roosevelt Road Long Legal "1-2" and "1-3" Industrial Relief from Sections 7-104.2 and 7-104.3 to permit an encroachment into the front yard to the property line. Present Use of Property; Industrial Proposed Use of Property: Same WMANZ, =,# - ful 14 The applicant plans to replace two old metal warehouse buildings with a modern structure as shown on the graphic. One of the existing buildings is presently encroaching into the right-of-way of East Roosevelt Road, but the new building will be set back inside the property line. The Board of Directors is in the process of closing t h e south 50 feet of the Roosevelt Road right-of-way wit,-, the intent of returning that property to the owners along the south side. This action, when completed, will make this request moot; however, because of the research and legal work to be done prior to its final approval, the action m be several months away. The applicant is requesting this variance so as to minimize the develop time. I Staff recommends approval. The applicant was present, and there were no objectors. Green Address: 43 Hill Lane Description: Lot 43, Rolling Hills Addition Zoned: "R-2" Single Family Variance Requested: Relief from Section 7-101.2d to per -nit an encroachment into the north yard to within 2 feet of the property line. Present Use of Property: Single Family Proposed Use of Property: Same STAFF RECOMMENDATION: The applicant began enclosing an existing covered patio, which was constructed prior to his purchasing this home, and was stopped by the Building Inspector. The ultimate intention is to completely enclose this area and have a door for security. The present roof will also be replaced and extended to the front and rear of the house. It will have no overhang to the north. Staff sees no problems with adjacent properties. Staff recommends approval. BOARD ACTION: The applicant was present, and there were no objectors. After a brief discussion, the Board -moved to approve the application as filed. The motion passed: 5 ayes, 0 noes, 1 absent and 1 vacancy. December 20, 1982 Item No. 4 - Z-3934 Owner: Address: Description: Zoned: Variance Requested: Present Use of Property: Proposed Use of Property: NSTIT��� 5512 S. Grandview 0291MINEW "R-2" Single Family Relief from Section 7-101.2d to permit an side yard varying from 0.9 feet to 4.7 feet for a garage addition. Single Family STAFF RECOMMENDATION: The applicant plans to construct a new garage next to the existing garage. The house to the south sets very close to the intervening property line. Several trees appear to be in jeopardy if this construction takes place. Staff is most concerned that this proposal will create a too tight relationship between houses. Staff recommends denial. The applicant had requested deferral. The Board moved to defer the item to the January 17 meeting. The motion passed: 5 ayes, 0 noes, 1 absent and 1 vacancy. December 20, 1982 Item No. 5 - Z-3938 Owner: Nathan Calhoun Address: 2701 N. Grant Description: Lots 5 and 6 and the south 21 feet of Lot 4, Block 19, Parkview Addition Zoned: IIR-2" Single Family Variance Requested: Relief from Section 7-101.2d to permit no setback on the south side yard for a carport® Present Use of Property: Single Family Proposed Use of Property: Same The applicant proposes a carport which will project into the street right-of-way as shown. There is an existing rock wall located in the right-of-way which extends westward from the southwest corner of the proposed structure to the intersection and around the corner. The encroachment proposed for the carport will also require franchise from the Board of Directors. Both Planning staff and Engineering have reviewed this proposal and see no problems associated with the proposal as shown.® Staff recommends approval. The applicant was present, and there were no objectors. After a brief discussion, the Board moved to approve the application as filed. The motion passed: 5 ayes, 0 noes, 1 absent and I vacancy.
