II. Approval of the Minutes of the Previous Meeting The minutes were approved as mailed out. III. Members Present: Members Absent: City Attorney: Sam Anderson Marcelline Giroir Jerry Wilcox Ray Fureigh Jack Taylor Jim Summerlin Kirby Smith Jack Magruder September 17, 1979 Item No. 1 - Z-3393 Owner: Cornelia Terry Thomas Address: 4 Longfellow Lane Description: Lot 1, Cornelia Thomas Subdivision Zoned: "A" One Family Variance: Request variance from Section 43-12 (J) to permit a wall in excess of 6' in height. Present Use of Property: Proposed Use of Property: Single Family Single Family STAFF RECOMMENDATION: The wall in question is already in place and has been for some time. The wall is part of a larger landscaping plan which has been carried out. Staff finds no pressing reason for requiring either its removal or its shortening. Staff recommends approval of the height as presently constructed. Board Action: Dr. Peter Thomas, representing his wife, the applicant, gave a history of the wall's construction and the planning that went into both it and the adjacent landscaping. David Henry, representing David Dickey, the owner of the lot immediately to the north and also the sole objector on this issue, presented Mr. Dickey's argument that the height of the wall appears to make the lot smaller, it impairs visual distance, circulation and freedom to access the air. He further stated that several real estate people had told him that the wall diminished the value of his lot. A lengthy discussion ensued, and finally a compromise was offered in this matter. The compromise is as follows: Mr. Dickey would buy the brick involved to complete the rear side of the wall, and the Thomases would provide the labor to lay the brick on that side of the wall. Secondly, the level of the highest portion of the wall would be reduced to such that it would match the remaining portion of the wall height. Both owners, Mr. Dickey and Dr. Thomas, agreed to September 17, 1979 Item No. 1 - Continued this compromise. The Board moved to recommend approval of the height variance with the condition that the center portion of the wall be lowered to the same height as the adjoining portions of the wall and that Dr. Thomas furnish the labor to lay the brick facade on the rear portion of the wall. Mr. Dickey would provide the necessary materials. The motion passed - 5 ayes, 0 nays and 2 absent. September 17, 1979 Item No. 2 - Z-3394 Owner: Leroy Hamaker Address: Route 5, Box 442BB Little Rock, AR 72212 Description: Northwest Corner, Rummel Road at Mooser Lane Zoned: "A" One Family Variance: Request variance from Section 43-3 (7) to permit location of an accessory building nearer to the front property line than 601. Present Use of Property: Proposed Use of Property: Single Family Single Family STAFF RECOMMENDATION: The issue here is the location of an accessory structure. The existing mobile home residence of the applicant is a legitimately constituted nonconforming structure. The applicant has stated that the second mobile home was purchased for use as storage and workshop space clearly as an accessory to the principle structure. The hardship associated with the requested location of the accessory structure deals with periodic flooding and general wetness in the normal area of the rear yard designated for accessory structures. Staff recommends approval of the request with the condition that the kitchen and bath facilities be dismantled to preclude possible dwelling use of the accessory structure. Board Action: The applicant was present and stated to the Board that he was willing to comply with those conditions stated in the staff recommendation. After a brief discussion, the Board moved to approve the variance with the condition that only the kitchen capability of the mobile home be removed. The motion passed - 5 ayes, 0 nays and 2 absent. September 17, 1979 Item No. 3 - Z-3397 Owner: Address: Description: Shirley M. and James R. Burks By: Gary Young 3624 Malloy Street Lots 1 and 2, Block 200 John Barrow Addition Zoned: "B" Residence Variance: Request permission under the provisions of Section 43-22 (4) (d) to locate a day-care center in a residential district. Present Use of Property: Proposed Use of Property: Single Family Day -Care Center STAFF RECOMMENDATION: The request will allow conversion of an existing single family structure on two lots to use as a day-care facility. Malloy Street has been upgraded to City standards under the Community Development program. 36th Street is an arterial on the Master Street Plan. On -site inspection reveals reasonable access to the property and an adequate lot size for the proposed use. Staff recommends approval. Board Action: The applicant was present, and there were no objectors. After a brief discussion, the Board moved to approve the application as filed. The motion passed - 5 ayes, 0 nays and 2 absent. September 17, 1979 Item No. 4 - Z-3398 Owner: First Pentecostal Church By: Roger Toney Address: 4900 Interstate 30 Description: Northwest Corner of I-30 at Doyle Springs Road Zoned: "A" One Family Variance: Request permission under the provisions of Section 40-15 to locate a mobile home for security purposes. Present Use of Property: Church Proposed Use of Property: Church STAFF RECOMMENDATION: The First Pentecostal Church has suffered losses in excess of $4,000 due to theft and vandalism over the past several months. Installation of an alarm system has curtailed some of the loss. However, several recent problems have indicated that stronger steps must be taken. The requested permit will allow location of a mobile home to provide a residence for a full-time security person. Staff recommends approval. Board Action: The applicant was present and gave additional details regarding their proposal to locate the mobile home. There were no objectors. After a brief discussion, the Board moved to approve the application. The motion passed - 5 ayes, 0 nays and 2 absent. September 17, 1979 Item No. 5 - Z-3401 Owner: Retail Clerks Union, Local 1583 By: Ralph Green Address: 1201 Bishop Street Description: Lots 1, 2, 3 and the North 12' of Lot 4, Block 2, Centennial Addition Zoned: "E-l" Quiet Business Variance: Request variance from Section 43-14 (2) to permit a 5' encroachment into a required rear yard. Present Use of Property: Office Proposed Use of Property: Office STAFF RECOMMENDATION: The requested variance will permit an addition to an existing structure. The only side of the structure suitable for addition is the east side. The addition will replace a small parking area in the rear of the building. No harm to the spirit of the ordinance will come from this request. Staff recommends approval of the 5' encroachment. Board Action: The applicant was present, and there were no objectors. After a brief discussion, the Board moved to approve the application as filed. The motion passed - 5 ayes, 0 nays and 2 absent. September 17, 1979 Item No. 6 - Z-3388 Owner: Lieselotte Garms Sebastian Address: 3809 Plateau Description: The West 55.7' of Lots 1 and 2, Block 7, Plateau Addition Zoned: "B" Residence Variance: Request variance from Section 43-12 to permit an encroachment into a required side yard. Present Use of Property: Proposed Use of Property: Single Family Single Family STAFF RECOMMENDATION: The requested variance will permit addition of a utility room for installation of a washer and dryer on the first floor. The applicant states that a medical disability requires this request. Because of the alley, there will be no encroachment upon the neighboring properties. Staff recommends approval up to within 2.5' of the side property line. Board Action: The applicant was present, and there were no objectors. After a brief discussion, the Board moved to approve the application. The motion passed - 5 ayes, 0 nays and 2 absent.
