II. Approval of the Minutes of the Previous Meeting Minutes of the September meeting were approved as mailed out. III. Members Present: James Summerlin, Vice -Chairman Ray Fureigh Marcelline Giroir Jack Taylor Jerry Wilcox Members Absent: Samuel Anderson, Chairman Kirby Smith Attorney Present: Lester McKinley October 15, 1979 Item No. 1 - Z-3408 Owner: First Baptist Church of Highland Park By: Marquis E. Jones Address: Northwest corner of W. 18th Street and Oak Street Description: Lots 13, 14, 15 and 16, Block 12 and Lot 2, Block 15, Braddock's Addition Zoned: "B" Residence Variances: 1. Request a variance from Section 43-12 to permit a front yard of 17' and a rear yard of 131. 2. Request a variance from Section 43-12 to permit a steeple 52' in height. 3. Request a variance from Section 43-3 to permit as allowed by Section 43-21 an accessory parking lot in a residential zone serving a detached property. Present Use of Property: Vacant Proposed Use of Property: Church STAFF RECOMMENDATION: This request will allow construction of a new neighborhood church on the same site as that which serves the previous structure. On -site inspection revealed no evidence of hardship demanding any form of relief from zoning setback requirements. It appears that the proposed structure was designed by someone unfamiliar with City land use regulations. Staff recommends denial of the requested yard reductions, but staff recommends approval of the height variance and the parking variance as requested. October 15, 1979 Item No. 1 - Continued BOARD ACTION: The applicant was present and presented the Board with a lengthy history of the church's existence and of the process under which they had gone in order to achieve the financing, planning and permits for the new church. He explained that it was not until they had gotten to the actual building permit process that they had found they were in violation of the Ordinance. He stated that relative to the hardship issue, they felt the building perhaps could have been designed for the lot in a different manner. He stated that the present siting of the church was selected primarily to help the elderly and handicapped because of the change in grade across the property. He introduced a number of church members and the pastor of the church who were present in the audience, presented affadavits from neighboring property owners abutting the church property expressing support of the church's request, and stated that the church also planned with this new structure to expand its community service role as a kind of community center as well as church facility. There was no opposition. After a brief discussion, the Board moved to approve the requested variances. The motion was passed - 5 ayes, 0 nays and 2 absent.
