I. Roll Call and Finding of a Quorum
A quorum was present, being five in number.
II. Approval of the Minutes of the Previous Meeting
The minutes of the previous meeting were approved as
mailed out.

Variances: Request a variance from Section 43-16-1
(to permit milk storage tanks with a
height greater than 45 feet, the aerial
encroachment to be 56 feet total.
Present Use of
Property: Milk processing plant under
construction.
Proposed Use of
Property: Same
Staff Recommendation:
The applicant in this case is subject to a set of
circumstances over which he has little or no control.
Sizing of the milk storage tanks apparently is by volume
rather than by height, thereby creating a hardship unique to
the circumstances and site. The neighborhood land use and
zoning pattern reflect that the erection of the tanks will
not adversely affect other land users. Adjacent properties
south and east are occupied by the 100 Year Floodplain and
undoubtedly will remain vacant permanently, to the north and
west, predominately freeway and open space and large
industrial sites.
The staff recommends that the variance be granted as
requested, but that the height variance be limited to the
tank locations shown and that subsequent additions of excess
height be submitted for Board approval.
Board Action:
The applicant was present and there were no objectors.
After a brief discussion, the Board moved to approve the
application as filed. The motion passed: 5 ayes, 0 noes
and 2 absent.

Variances: Request a variance from Section 43-12 to
permit a plus or minus four foot
encroachment into a required rear yard.

Property: Remain the same
Staff Recommendation:
The subject property lies at the southerly end of Roswell
Court and rears upon a large permanent open space, being a
fairway of the Pleasant Valley Golf Course. The lot as
platted has a rather unique shape in that it has front and
rear lines that contain angles that are not coincident and
create a problem for expansion.
The staff feels the lot's shape, contour and siting adjacent
to a golf course all provide that little or no impact will
be felt by neighbors. The staff recommends approval of the
variance as filed.
Board Action:
The applicant was present and there were no objectors.
After a brief discussion, the Board moved to approve the
application as filed. The motion was passed: 5 ayes,
0 noes and 2 absent.

Staff Recommendation:
The staff review of this proposal reflects little to support
a hardship circumstance as required by ordinance. It
appears that over a lengthy period of time the School Board
has haphazardly expanded this facility and, in fact,
encroached onto a public street right-of-way. We are, at
this time, dealing with what may be the initial step in
correcting several deficiencies, both in structure and of
site use. The plan as filed illustrates that considerable
time and thought has been given to corrective actions.
The staff view and recommendation is that the proposal
contains more pluses than minuses, and that the public
interest would be served if the variance is approved. We do
feel that some attention should be given to the issue of
encroachment into "F" Street. If at all possible, this
street should be closed. We realize this would be difficult, due
to the adjoining owners to the north taking access to "F"
Street. It was also observed that the alley to the north is
open and in use. However, if the Board and applicant do not
feel that closure action is warranted, then a franchise will
have to be obtained from the Board of Directors prior to
issuance of building permits.
Board Action
Jerry Wilcox abstained, citing conflict of interest. The
applicant was present and stated that the necessary
franchise from the City Board of Directors has been
requested and should be acted on in the near future. There
were no objectors to the application, and after a brief
discussion of the development plans for the school property,
the Board moved to approve the! application as filed. The
motion was passed: 4 ayes, 0 noes, 2 absent and 1
abstention (Jerry Wilcox).
