STAFF RECOMMENDATION:
With its present location between two public utilities, the
property could hardly be better used than as proposed by the
applicant. Staff recommends approval.

After a brief discussion, the Board moved to approve the
application as filed. The motion passed: 6 ayes, 0 noes,

STAFF RECOMMENDATION:
The location seems reasonable for the proposed use. Staff's
assessment of the area in connection with the John Barrow
C.D.B.G. area plan shows a relatively high density of
children within this neighborhood. The only negative aspect
of this case is the limited street system as it applies to
this property.
Traffic access is limited by narrow, poorly constructed
streets. However, the limited access also contributes to
the value of this site for a child care location. Traffic
intended for this site will not have to compete for space
with traffic bound for other destinations. Low noise levels
because of the limited traffic are another plus.
The staff feels that while the public access problem is
somewhat serious, the success or failure of the operation
will be self-regulating. Staff therefore recommends
approval.

STAFF RECOMMENDATION:
The proposed encroachment would permit the addition of a
fourth service bay onto an existing building. On -site
investigation reveals no particular problem which might be
created by the addition. There is, however, one side issue
which should be addressed.
Staff observed the external storage of "trade-in" tires
lying near the eastern property line. A neighboring
property owner has complained that these tires sometimes are
found over on adjacent property, probably due to the efforts
of kids playing after hours.
Staff feels it reasonable to condition the approval of this
expansion of the use on a requirement that the salvage
materials - tires and auto parts - be kept within the
confines of some type of enclosure, preferably something
which is opaque.
Staff recommends approval as conditioned above.
BOARD ACTION:
The applicant was present and there were no objectors. Euel
Forest, a neighboring property owner, did ask to be heard
and offered a provision requiring that the applicants build
some kind of enclosure which would provide for the safe
storage of the loose materials kept around the business. He
also discussed with the Board the problem that some of the
tires that had been stored outside in the past were being
rolled down into neighboring properties, apparently by

children who played in the yard after working hours for the
service station. The applicant's agent, Steve Goss, stated
that the applicants were willing to comply with Mr.
Forest's request that the materials be kept under more
secure storage.
After a brief discussion, the Board moved to approve the
variance request with the condition that a suitable type of
enclosure be constructed to house the salvage materials as
stated in the Staff Recommendation. The motion was passed:
6 ayes, 0 noes, 1 absent.

STAFF RECOMMENDATION:
As can be seen from accompanying sketch, the siting of the
existing structure is the result of working around a 35'
wide gas easement. The proposed addition will encroach into
the required side yard a distance of 3' at the foundation
line. However, the roof overhang will project 4' rather
than the allowable 2' and a total 5' encroachment will
occur.
Staff sees no harmful effects to be derived from the
proposal and no harm to the spirit of the Ordinance. Staff
recommends approval.
