II. Approval of the Minutes of the Previous Meeting Minutes of the November meeting were approved as mailed out. III. Members Present: Samuel Anderson, Chairman Jack Taylor Marcelline Giroir Jerry Wilcox James Summerlin Members Absent: Ray Fureigh City Attorney: Lester McKinley December 17, 1979 Item No. 1 - Z-3421 Owner: Bernie F. Jungkind III Address: 724 Pine Valley Road Description: Lot 53, Queen Manor Addition Zoned: "A" One Family Variances: Request variance from Section 43-12 (3) to permit a 5.7' encroachment into a required side yard. Present Use of Property: Single Family Residential. Proposed Use of Property: Same Staff Recommendation: The purpose of this request is to allow enclosure of an existing carport. No additional encroachment into required open space will take place. The staff recommends approval. Board Action: Staff notified the board that Mr. Jungkind had not been able to mail out the proper notice in time for the meeting, and as a result the required action by the board would be to defer the matter to the January 21 meeting. The Board moved to defer the matter to the next meeting. The motion passed 5 ayes, 0 noes, and 1 absent. December 17, 1979 Item No. 2 - Z-3423 Owner: Elech and Peggy Bewley Address: 6501 Brookview Drive Description: Lot 261, Brookwood Addition Plat #4, Section A Zoned: "A" One Family Variances: Request permission under the provisions of Section 43-22(4)(d) to establish a day-care facility in a residential zone. Present Use of Property: Single Family Residential. Vacant. Proposed Use of Property: Day -Care Center Staff Recommendation: This request will permit the conversion of a single family dwelling into a day-care facility. There are other day-care facilities in this general area, principally along West 65th Street. Neighboring property owners have expressed concern over possible bill of assurance violation and potential traffic problems. Brookview Drive provides one of the major access points to Brookwood Subdivision to the south. Staff does not wish to initiate nonresidential development in this area nor participate in the violation of a bill of assurance. Staff recommends denial. Board Action: The applicant was present, addressed some of the issues mentioned in the staff recommendation and cited that their operation would be licensed for only 18 children. They further addressed the traffic problems that staff had shown concern about and discussed their plans for providing a new driveway to permit safe pickup and delivery of children. There were several objectors present. They were Dorothy Brown, Tom Boyles, Louise Butcher and John Weaver. All of these neighboring owners spoke in opposition to the proposed Day -Care Center and cited primarily traffic problems that they expected as a result of the peak hour traffic to the Day -Care Center, as well as their attempts to get to and from work at those same peak hours. December 17, 1979 Board Action Cont: The applicant was offered an opportunity and rebutted some of the statements made by neighboring owners, and cited the success of operation of a similar Day -Care Center that they had on Geyer Springs Road in a similiar traffic circumstance. After a brief discussion, the board moved to deny the application. The motion was passed 5 ayes, 0 noes, and 2 absent. December 17, 1979 Item No. 3 - Z-3426 Owner: Baptist Medical Center By Joe Norcross Address: 9601 Interstate 630 Description: Lot 2, Baptist Medical Center Development Zoned: "C" Two Family Variances: 1. Request permission under the provisions of Section 43-22(4)(d) to expand an existing hospital and hospital related parking in a residential district. 2. Request variance from Section 43-12(1) to permit an additional height encroachment of 22'. Present Use of Property: The Baptist Medical Center Proposed Use of Property: Same Staff Recommendation: Previously, the Baptist Medical Center was granted a waiver to allow a height of 170'. This request will increase that allowable height by about 22'. The design of the structure and its functional layout virtually demand vertical expansion when additional beds are required. Horizontal expansion is suitable only for ancillary facilities. Variance requests have been made to enable both forms of expansion in this instance. First, a request for permission to expand the hospital facility, including parking, (technically a nonconforming use) has been made; and second, a request for an additional height variance has been made. Staff recommends approval of both requests. Board Action: The applicant was present and there were no objectors. After a brief discussion, the Board moved to approve the application as filed. The motion was passed 4 ayes, 0 noes, 1 absent and 1 abstention. Jerry Wilcox abstained citing conflict of interest. December 17, 1979 Item No. 4 - Z-3427 Owner: Jim Fowler By Melvin Garrett Address: 7017 Rockwood Road Description: Lot 271, Kingwood Place Addition Zoned: "A" One Family Variances: Request variance from Section 43-12 to permit a 6' encroachment into a required rear yard. Present Use of Property: Single Family Residential Proposed Use of Property: Same Staff Recommendation: As depicted in the accompanying graphic, the house is located to the 25' rear yard setback line. The proposed addition to the house will project into the yard space approximately 61. On -site inspection reveals that no adverse impacts upon neighboring properties are likely. Staff recommends approval. Board Action: The applicant was present and there were no objectors. After a brief discussion, the board moved to approve the application. The motion was passed 5 ayes, 0 noes and 1 absent. December 17, 1979 Item No. 5 - Z-3165 (Extension) Owner: Winrock, Homes, Inc. By Steve Lowry Address: Pecan Lake Subdivision Description: Sales Office, Winrock Homes Zoned: "A" One Family c+-mff PnonmmAnAni-inn! Winrock Homes, Inc. has requested an extension of time for use of a model home as a sales office within the Pecan Lake Subdivision. The original variance was granted in 1977 for a period of 24 months. Staff recommends the granting of an extension of time, not to exceed 90 days beyond the sale of the last lot in this Winrock development. Board Action: Staff amended its recommendation to limit the extension to a 24 month period. After a brief discussion, the Board moved to approve the 24 month extension of the sales office use. The motion was passed 5 ayes, 0 noes and 1 absent. December 17, 1979 In other business, the board approved the calendar for the year 1980 on a motion 5 ayes, 0 noes and 1 absent.
