II. Approval of the Minutes of the Previous Meeting The minutes of the July meeting were approved as mailed out. III. Members present: Jerry Wilcox Kirby Smith Ray Fureigh Jack Taylor Members absent: Marcelline Giroir James Summerlin Samuel Anderson City Attorney present: Carolyn Witherspoon August 20, 1979 Item No. 1 - Z-3365-A Owner: Don and Mary Scott Address: 422 Martin Street Description: Lot 6, Block 6, C.H. Taylor Addition Zoned: "C" Two Family Variance: Request variance from Section 43-12 to permit encroachment into a required yard. Present Use of Property: Single Family Residential Proposed Use of Property: Two Family Residential STAFF RECOMMENDATION: This property was recently the subject of a rezoning action to permit the construction of the proposed duplex. Staff supported the zoning action with the knowledge that the requested variance would be required. Staff recommends approval of the required variance calling for a 15 foot rear yard reduction and a three foot side yard reduction. BOARD ACTION• The applicant was present and there were no objectors. After a brief discussion, the Board moved to approve the application as filed. The motion passed: 4 ayes, 0 noes, 3 absent. August 20, 1979 Item No. 2 - Z-3387 owner: Address: Description: Zoned: Variance: Present Use of Property: Bob Thomas 7323 Indiana Street Lots 11 and 12, Block 6, Forest Park Highlands "C" Two Family Request variance from Section 43-21-(J) to permit a wall in excess of the permitted height. Duplex (under construction) Proposed Use of Property: Duplex STAFF RECOMMENDATION: At issue here is a retaining wall located on the north and east property lines of this parcel. The wall is designed to permit leveling of the yard abutting Indiana Street. However, the wall as constructed produces a difficult sight problem for vehicles attempting to leave the driveway just east of the wall on a neighboring property. The only solution staff sees for resolving the sight problem while allowing for the leveling work intended by the applicant is to change the configuration of the wall to angle across the corner at something approaching 45" from the proposed driveway and the wall as it extends along the east property line thereby creating a setback of the east wall of some 12 to. 15 feet. Staff recommends that this course of action be followed. BOARD ACTION• Staff informed the Board that the applicant had not complied with the requirements of the filing procedure; specifically, that he had not paid the fee or filed proof of notice to neighboring property owners. Staff, therefore, recommended that the matter be deferred to September. The Board moved to defer the matter to September. The motion passed: 4 ayes, 0 noes, 3 absent. u August 20, 1979 Item No. 3 - Z-3379 Owner: Address: Description: zoned: Variance: Present Use of Property: Proposed Use of Property: Jack and JOAnn Files 916-924 Commerce Street Lots 7, 8 and 9, Block 59 original City "BR" High Density Residential Request permission under the provisions of Section 43-35 (2) to establish a professional office in the "HR" District. Apartments Professional Office/Apartments STAFF RECOMMENDATION: The applicant proposes to establish a professional office on the first floor of the structure and retain the apartment uses with the remainder of the building. The only problem staff sees in the request is one common to this entire of the City, and that is parking. There seems to be a shortage of adequate parking facilities, and staff feels this issue must be addressed in conjunction with the conditional use permit. Staff would not be opposed to a limited waiver of some of the required parking for this particular site. Staff recommends approval of the conditional use permit conditioned upon resolution of the parking issue. BOARD ACTION• The applicant was present, and there were no objectors. A lengthy discussion was held concerning the parking situation. The applicant stated that there were 24 apartment units in the building and that his desire was to use only the first floor of the structure; specifically, some 7000 square feet of floor space for offices. A quick calculation was that the applicant would need to provide approximately 36 parking spaces for the total structural requirement, that is 16 for apartments and 20 additional spaces for the 7000 square feet of office space. The discussion never completely resolved the parking issue. August 20, 1979 Item No, 3 - Continued Sandy Hanson was present and expressed the concern of the MacArthur Park Association about the parking, and their fear that MacArthur Park might be used to offset the lack of parking on many of the uses surrounding it, After the lengthy discussion, the Board moved to approve the application for a conditional use permit to be limited to the use of the first floor of the structure, The motion passed: 4 ayes, 0 noes, 3 absent, There was no motion made regarding the parking requirement, August 20, 1979 Item No. 4 - Z-3389 Owner: Address: Description: Zoned: Variance: Present Use of Property: James Rose By: Marleen Palmer 2321 Vancouver Drive Lot 1, Block 4, Phase I, Parkwood Addition "A" One Family Request permission under the provisions of Section 43-22 (4) (d) to permit establishment of a day-care facility in a residential district. Residential/Baby-sitting Service Proposed Use of Property: Day -Care Center STAFF RECOMMENDATION: On the premises, there is an existing day-care type facility. The requested variance would permit the addition of several children to the existing service. No particular physical changes in the property are anticipated. The proposed use is, in the staff's opinion, not compatible with the surrounding land uses, all of which are single family residential. Also, the requested use would be a direct violation of the Parkwood Addition Bill of Assurances. Staff recommends denial. BOARD ACTION: Staff informed the Board that the applicant had requested that the application for this variance be withdrawn and that she further be allowed to refile within the next twelve months if she so desires. The Board moved to accept the withdrawal. The motion passed: 4 ayes, 0 noes, 3 absent. August 20F 1979 In other action, the Board requested Staff to set up a meeting between Staff members and the Board to discuss the new Zoning Ordinance as it pertains to the Board of Adjustment.
