Eric,
Thanks for the responses to the Civil Engineering comments. Engineering staff is in support of your
application and variances with a few exceptions as found below.
1. Submit the right-of-way abandonment application to LaSonya Morris in the Planning Department;
2. A letter or email formally requesting a variance from the Master Street Plan to not dedicate right-of-
way30 ft from the centerline of Shadow Lake Drive and justification for the variance must be
submitted to LaSonya Morris;
5. Staff cannot recommend a waiver of the requirement from the Boundary Street Ordinance and CLR
Building Codes to construct sidewalk adjacent to Shadow Lake Drive. There is no sidewalk on Shadow
Lake Drive currently. The only existing sidewalk is along Markham St. The Building Codes require
pedestrian access to be provided from the development to the ADA compliant pedestrian pathway
provided within the right-of-way. Your plan does not show and ADA compliant pedestrian access from
the development to the right-of-way and due to the retaining walls and proposed slopes the only
pedestrian access would be to a sidewalk constructed in the right-of-way along the property frontage
adjacent to Shadow Lake Drive which is a requirement of the Boundary Street Ordinance and Building
Codes. To address the sidewalk ADA compliance question, the ADA guidelines for sidewalk in the right-
of-way are different from ADA guidelines on private property. Within the right-of-way, the running
slope of the sidewalk or pedestrian pathway can match the running slope of the adjacent street but not
exceed a 1% difference. Due to grades adjacent to the Shadow Lake Drive back of curb, a 6 ft sidewalk
can be placed at the back of curb. If not desired, a 5 ft sidewalk is required to be constructed with the
back of sidewalk placed at the property line.
14. A letter or email formally requesting a variance from CLR Code, Sec. 31-210 to allow a driveway
to exceed 26 ft in width on a minor commercial street and justification for the variance must be
submitted to LaSonya Morris.
