Re: Outline of Proposed Planned Zoning Development at 7820 Cantrell Road (the "Property")
Bark Avenue has completed its preapplication conference with Jamie Collins via a phone
call on December 4, 2020, as required as a prerequisite to application for rezoning. See City Code
§ 36-454(b). Thus, Bark Avenue now seeks a PD-C rezoning of the Property.
This document provides an outline of the proposed PD-C at the Property as required by the
City Code, following the criteria set forth in City Code § 36-456(1).
A statement describing the character of the development and including the rationale behind
the assumptions and choices made by the application. City Code § 36-456(1)(a). As more
fully discussed in the cover letter, Bark Avenue hopes to open a single -use animal kennel
at the Property and believes a PD-C to be the best and most efficient rezoning option to
allow operation of the animal kennel thereon.
II. Quantitative Data. City Code § 36-456(1)(b).
a. Parcel size: 0.89 acres.
b. Types and numbers of permitted uses and floor areas: Single -use animal kennel,
utilizing the entire Property.
c. Proposed building coverage: Existing buildings — 6,037 square feet. Additional
building to be constructed (additional indoor play area) — est. 500 square feet.
d. Total acreage of private and common usable and nonusable open space by type:
The entire Property will be private usage.
III. Topographical cross section map of the site. City Code § 36-456(1)(c). The topography
will be included on the final site plan.
IV. Site plan. City Code § 36-456(1)(d). The preliminary site plan is included with this
application, and a final site plan will be submitted when received. Additional information
regarding the site plan is as follows:
a. Existing and proposed circulation system of all streets, including off-street parking
areas, service areas, loading areas, and major points of access to public rights -of -
way. City Code § 36-456(1) (d) (4). The preliminary site plan shows the point of
access on the southwest corner of the Property. The gated driveway in the middle
of the southern Property boundary will remain closed, but Bark Avenue may open
it if additional parking is needed in the vacant area on the eastern half of the
Property.
b. Existing and proposed pedestrian circulation systems. City Code § 36-456(1) (d) (5).
Staff and clients will enter the Property through the office building noted on the
preliminary site plan.
C. Proposed treatment of the perimeter of the property. City Code § 36-456(1) (d) (6).
Bark Avenue will replace the existing dilapidated fence on the west, north, and east
sides of the Property with a new fence in compliance with the screening
requirements of the City Code. Bark Avenue will also install trees and shrubs along
all sides of the Property in compliance with the landscaping requirements of the
City Code. The fence and landscaping placement will be noted on the final site plan.
d. Location and size of all areas to be conveyed, dedicated, or reserved as common
open spaces, public parks, recreational areas, school sites and similar public and
semipublic use. City Code § 36-456(1)(d)(8). Bark Avenue does not plan to
dedicate any part of the Property for public use. The Property will be a single -use
commercial development.
e. Location, dimensions, nature of all existing and proposed easements and public
improvements. City Code § 36-456(1)(d)(9). Existing easements are noted on the
preliminary site plan. Bark Avenue does not plan to enter into any new easements
or construct any public improvements.
f. Description of the following existing conditions of the Property: contours at two -
foot intervals; watercourses; floodplains; unique natural features; forest cover.
City Code § 36-456(1)(d)(11). None of these conditions exist at the Property.
g. A development schedule indicating the approximate date when construction of the
planned unit development or stages of the planned unit development can be
expected to begin and be completed. City Code § 36-456(1) (d) (13). Development
will include constructing the new indoor play area, soundproofing the buildings,
installing the fence and the landscaping around the perimeter, and generally
cleaning up the Property. Bark Avenue plans to commence development of the
Property upon approval of its PD-C application and to complete development by
summer of 2021.
h. A statement of the applicant's intentions with regard to the future selling or leasing
of all or portions of the planned unit development. City Code § 36-456(1) (d) (14).
Bark Avenue has no plans to sell or lease the Property in the future except for a
potential lease to an oper� tiny; entity owned by the members of Bark Avenue.
i. An approved preliminary plat in accordance with chapter 31. City Code § 36-
456(1)(d)(15). Bark Avenue is not requesting approval of a plat with this
application.
j. The location of handicapped parking stalls and accessibility requirements of
Arkansas State Fire Code. City Code § 36-456(1)(d)(16). Bark Avenue will mark
one of the eight existing parking spaces for handicapped use in compliance with
the Fire Code.
V . A graphic or narrative outline of methods to be employed to protect permanent undisturbed
buffers. City Code § 36-456(1)(e). As noted herein, Bark Avenue will install a new and
more effective fence and landscaping around the perimeter of the Property in compliance
with the requirements of the City Code. Bark Avenue will maintain the fence and
landscaping in good condition and repair.
VI. The applicant shall submit a copy of a valid bill of assurance for the subdivision within
which the subject property is located if such property is located within a subdivision
covered by a valid bill of assurance. City Code § 36-456(1)(1). The Property is located
within the Bellevue Addition, which plat was recorded on July 1, 1914, in the plat records
of Pulaski County. The neighborhood has no separate bill of assurances beyond the
restrictions noted on the plat. Bark Avenue has requested a copy of the plat from its title
company but unfortunately has not yet received it. Bark Avenue will submit the plat to the
Commission as soon as it is received.
