The site he proposes to develop under the current application includes a 2-story apartment building which he intends to convert to "upscale offices or apartments". The site to the west, at the corner of west 13th. Street and Louisiana Street, contains a 2-story residence and a detached garage. The applicant proposes to provide parking for the POD across West 13th. Street on an existing parking lot which he owns. A. Requested is approval of a POD district for "upscale offices or apartments,, in an existing 2-story building. The applicant proposes to divide a site which currently contains the 2-story building, a 2-story residence, and a detached garage, and retain the 2-story building for development. Parking is proposed to be across West 13th. Street on a parking lot the applicant currently owns. B. EXI TING ITI The site is currently zoned HR. The building is a condemned 2-story apartment building. The lot which would result from the division of the site would be 40 feet by 85 feet. The building is 35.2 feet by 66.8 feet. Wastewater Utility reports that the sewer mains located on the east side of the property. The Fire Department approved the submittal without comment. AP&L approved the submittal without comment. D. ISSUESILE-GALITECHNICAL1VESIG : A statement describing the character of the development and including the rationale behind the assumptions and the choices made by the applicant is required. The statement ------- - furnished is inadequate and incomplete. The site plan is to include the entire area of 113 W. 13th. Street and 1223 Louisiana Street as one plat, with two lots shown-- The parking lot across 13th. Street is to be included in the platted area. The required parking which is proposed across 13th. Street is to be tied to the site in both the plat and in the Sill of Assurance. The parking layout is to be shown. The proposed treatment of the perimeter of the property is required. A schematic landscaping plan is required. A development schedule is to be reported. A statement of the applicant's intentions for selling or leasing or all or portions of the project is required. The names of abutting subdivisions, including the book and page number or -instrument number; is -required to be shown. The zoning classification of the site and of abutting property is to be shown. Engineering and surveying certifications are required to be provided and executed on the plat. ALY I The submittal has severe deficiencies, and the applicant has failed to respond to requests for a conference to discuss the deficiencies. The applicant has provided a narrative for only the one building which he wishes to develop, but fails to deal with the status of the remaining buildings which are on the same lot. There is no provision for sub- dividing the lot into two lots, nor for assuring that the parking lot across the street will be legally tied to the proposed development to provide for the required parking. The application was submitted as a result of enforcement action which was pending for an illegal division of the site into two tracts and the sale of the abutting tract. F. STAFF RECOMMENDATIONS: Staff recommends denial of the application. SUBDIVI$IQN COMMITTEE MME ,A : ( September 16, 1993 ) No one was present to represent the applicant. Staff reviewed the deficiencies noted in the discussion outline. The Committee referred the matter to the Commission for consideration. PLANNING COMMISSION ACTION: (OCTOBER 5, 1993) Staff reported that the applicant was present and had asked prior to the meeting that the item be deferred until the November 16, 1993 Commission meeting. The item was included on the consent agenda for deferral and was passed by the Planning Commission with the vote of 8 ayes, no nays, 2 absent, no abstentions, and 1 open position. TAFF PDATE The applicant has amended the request to include a co -applicant and to change the scope of the request. The co -applicant is the owner of the house at 1223 S. Louisiana Street: Tony Curtis, 7300 Ederville Rd., #1221, Ft. Worth, TX 76112, (817) 654-2678. The property is proposed to be divided as shown on the plan, with Mr. Curtis retaining the property associated with the home, and Mr. Abernathy retaining the property associated with 112 W. 13th. St. Mr. Abernathy plans to raze the apartment building located on his portion of the property and construct a parking lot on the site. The existing parking lot across 13th. Staff related to Mr. Abernathy that a plat needs to be prepared which reflects the proposed division of the property and the layout of the proposed parking lot. A Bill of Assurance needs to be prepared and presented. Conformance with the Landscaping Regulations must be met in the planning of the parking lot. Following a brief overview of the request and the --amendment- to- the request: the Committee forwarded the request to the Commission for review. PLAU UNING CQHMI§SIQN A TT (November 16, 1993) Staff presented the itemand recommended approvalwith the conditions that the applicant file a plat properly dividing the property as submitted, and submit a development plan for the 112 W. 13th. Street site showing the proposed parking lot with buffers and landscaping as required. The item was included on the consent agenda for approval and was approved with the vote of S ayes, no nays, 2 absent, no abstentions, and 1 open position. 4 0 ORDINANCE NO. 16,532 AN ORDINANCE APPROVING A PLANNED UNIT DEVELOPMENT AND ESTABLISHING A PLANNED COMMERCIAL DEVELOPMENT DISTRICT TITLED ABERNATHY-CURTIS SHORT -FORM PCD (5-5725), LOCATED AT 112 W. 13TH. STREET & 1223 S. LOUISIANA STREET, IN THE CITY OF LITTLE ROCK, A.RKANSAS, AMENDING CHAPTER 36 OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION I. That the zone classification of the following described property be changed from HR to PCD. A parcel of land in Section 10, T-1-N, R-13-W, Little Rook, Arkansas, and located at 112 W. 13th. Street & 1223 S. Louisiana Street, being more particularly described as follows: South 10 feet of East 40 feet of North 1/2 of Lot 5; and South 1/2 of Lot 5; and all of Lot 6, Block 67, Original City of Little Rock. SECTION 2. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 3. That the change in zoning classification contemplated for Abernathy -Curtis Short -form PCD is conditioned upon obtaining final plan approval within the time specified by Chapter 36, Article VII, Section 36-454(d) of the Code of Ordinances. SECTION 4. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and it is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section i hereof.
