RE: Street Right -of -Way Abandonment Application
UAMS Jack Stephens Drive
Dear Monte:
Enclosed are the following application materials for our request to abandon a portion of
Jack Stephens Drive from the south right-of-way line of Plateau Street to the south right-
of-way line of 6ch Street. The following items are provided:
1. Petition for right-of-way abandonment.
2. Exhibits A and B providing illustrations and descriptions of the subject street
right-of-way areas.
3. Owner's affidavit authorizing DCI to act as agent for this procedure.
4. CLR Public Works determination that a right-of-way dedication agreement is not
required.
5. Email statements of approval from CLR Public Works and utility representatives.
6. Abstractor research identifying the sources of dedication for the proposed right-
of-way areas and determination of reversionary rights (none).
7. Abstractor's findings and opinion that "According to the City of Little Rock the
west half of Elm Street was most likely never dedicated because it was always
owned by the State of Arkansas."
8. Copies of the plats of record indicating the original right-of-way dedications.
9. A copy of the ordinance that changed the street name from Elm Street to Jack
Stephens Drive in 2003.
10. Our check for the filing fee of $125.00.
Please note that our exhibits describe the right-of-way areas generally, and that the
exhibits imply a full normal width along the street (not just the verified right-of-way). We
have shown the area in this manner because the physical street improvements and
public use presently occupy this area, and we want to be clear about the street
becoming private.
