Hi Vince and Ilona,
My wife and I are working on our responses to the comments we received from Torrence Thrower in
regards to our proposed pool design plans and we have some questions. Torrence recommended that we
contact you both for questions about the comments in the Civil Engineering section in the attached
document.
We asked our neighborhood town architect, Steve Grisham, to review the comments as well, since he
has a better understanding of the verbiage and he responded with the following:
“The POA covenants allow fencing on the property line at side and rear yards. Brodie Creek Trail is a
side yard. There is nothing in our guidelines regarding corner lots on Brodie Creek or such a
requirement. I know the City will have concern about sightlines at intersections, however was not aware
of the 50 foot requirement. Brodie Creek Trail is 80 feet wide plus a 10 foot easement and 20 foot
building setback, and Deerberry Forest is 50 feet wide with 10 foot easements and does not have much
traffic on it so you might be able to discuss this with them to compromise on a solution. Since people
turning onto Brodie Creek from Deerberry Forest are in the West lane then the vehicle would be at least
25 feet plus 20 foot setback from front of your house. They may allow you to clip the corner 5 feet at 45
degree angle to accommodate his concern. I don't see an issue turning from Brodie Creek unto
Deerberry Forest. I would call the civil engineer and see if they might consider a 45 degree section of
fence at the corner to alleviate some of his concern and allow you to keep the main fence line on the
property line. However, that will get into some of your planned elements on the West end.”
Would it be possible to find a time to discuss with you Steve’s comments above and discuss any options
we might have that could both satisfy any concerns you have and allow a portion of the fence to be
extended to the property line. If I understand correctly, this would entail building the fence at an angle for
part of the yard to allow for better line of sight.
If it helps the discussion, we have also attached views from the front seat of our car for the current sight
line with our fence from the end of our alley and from the stop sign at Deerberry Forest Circle (looking
onto Brodie Creek Trail).
Lastly, the city notified us late yesterday afternoon that we have until next Wednesday to respond with
comments, so hopefully we can find a time to talk before then. We are available this afternoon if that
happens to work.
