Manual, stormwater detention is required to be provided for all developments 1 acre and larger.
Typically, stormwater detention facilities are constructed within the subject property known as on-site
detention. Per Sec. 29-103 alternatives to construction of on-site stormwater detention facilities are
available. The Rosemary Villas at Chenal PRD applicant is requesting the use of an existing private sub-
regional detention facility constructed over 20 years ago by the Chenal Valley Property Owners’
Association and Deltic Real Estate LLC. The private sub-regional detention facility located within the
Chenal Valley golf course and constructed in conformance with the approved sub-regional detention
drainage study submitted only provided detention for the properties within the Chenal Valley
Subdivision where the detention facility was located and not for the Rosemary Villas at Chenal property.
Sec. 29-103(5) states the acquisition of regional or sub-regional detention sites and construction of such
detention facilities used as alternatives to on-site detention facilities will be financed by the City of Little
Rock. The Rosemary Villas at Chenal applicant proposes to use a privately owned sub-regional detention
site not financed by the City of Little Rock as an alternative to constructing on-site detention facilities in
contrast to Sec. 29-103(5).
The code continues and further addresses the use of regional or sub-regional detention facilities as
alternatives to on-site detention in Sec. 29-103(6) by stating the boundaries of watersheds and priority
of acquisition by the City of regional and sub-regional detention sites in construction of detention
facilities and location shall be established by the Department of Planning and Development and
approved by the Planning Commission. The proposed Rosemary Villas at Chenal PRD application does
not propose the use of a proposed City financed regional and sub-regional detention facility nor does
the applicant propose the use of an existing City financed regional or sub-regional detention facility so
therefore, the Department of Planning and Development cannot establish the location of a proposed
City financed regional or sub-regional detention facility for this application for consideration by the Little
Rock Planning Commission. Therefore, in conformance with city code, on-site stormwater detention
facilities shall be provided for the Rosemary Villas at Chenal PRD in conformance with the City of Little
Rock municipal code and the City of Little Rock Stormwater Management and Drainage Manual.
