RESOLUTION NO. 2021-01
A RESOLUTION RECOMMENDING AND CONSENTING THAT A CERTAIN
SANITARY SEWER EASEMENT IN FAVOR OF THE CITY OF LITTLE ROCK FOR
THE USE AND BENEFIT OF THE LITTLE ROCK WATER RECLAMATION
COMMISSION LOCATED WITHIN THE PROPERTY OF FOUNTAINE BLEAU
WEST APARTMENTS, BE ABANDONED.
WHEREAS, Burkhalter F.B.W., LLC, an Arkansas company, is the current owner of the
properties in Fountaine Bleau West Apartments, at 4216 South Bowman Road in Little Rock, Arkansas;
and
WHEREAS, Claudia Sparrow dedicated a sewer easement across aforementioned property by
Instrument Number 93-42504, filed for record on June 30, 1993; and
WHEREAS, Burkhalter F.B.W., LLC has installed new sewer mains on the property to reroute
the old sewer main to facilitate developing the property; and
WHEREAS, Burkhalter F.B.W., LLC has dedicated and recorded new sewer easements to cover
all public sewer mains on the property; and
WHEREAS, the full length of the old sewer main is no longer in use and a portion thereof has
been abandoned and removed; and
WHEREAS, Burkhalter F.B.W., LLC has now requested that the right-of-way easement,
dedicated by Instrument Number 93-42504, for the old sewer main be abandoned in favor of the new
sewer easement; and
WHEREAS, LRWRA agrees that it no longer has need for such easement, LRWRA requests
that the City of Little Rock execute an Abandonment of Easements Rights.
NOW, THEREFORE, BE IT RESOLVED BY THE LITTLE ROCK WATER
RECLAMATION COMMISSION, THAT:
The City of Little Rock is hereby requested to approve Burkhalter F.B.W., LLC's petition
for Abandonment of Easement Rights.
2. This Resolution shall be in full force and effect from and after its adoption and approval.

A RESOLUTION RECOMMENDING AND CONSENTING THAT A CERTAIN
SANITARY SEWER EASEMENT IN FAVOR OF THE CITY OF LITTLE ROCK FOR
THE USE AND BENEFIT OF THE LITTLE ROCK WATER RECLAMATION
COMMISSION LOCATED WITHIN THE PROPERTY OF COSTCO WHOLESALE
CORPORATION, BE ABANDONED.
WHEREAS, Costco Wholesale Corporation, a Washington corporation, is the current owner of
the properties in Lots 1-4, Kirkland Little Rock Addition, in Little Rock, Arkansas; and
WHEREAS, John W. Shackleford and Johnnie Mae Shackleford, husband and wife, dedicated
a sewer easement across aforementioned property by Instrument Number 94-36052, filed for record on
May 13, 1994 and corrected by Instrument Number 94-51534, filed for record on July 14, 1994; and
WHEREAS, Costco Wholesale Corporation has installed new sewer mains on the property to
reroute the old sewer main to facilitate developing the property; and
WHEREAS, Costco Wholesale Corporation has dedicated and recorded new sewer easements
to cover all public sewer mains on the property; and
WHEREAS, the full length of the old sewer main is no longer in use and a portion thereof has
been abandoned and removed; and
WHEREAS, Costco Wholesale Corporation has now requested that a portion of the right-of-
way easement dedicated by Instrument Number 94-36052 and corrected by Instrument Number 94-
51534, for the old sewer main be abandoned in favor of the new sewer easement; and
WHEREAS, LRWRA agrees that it no longer has need for such easement, LRWRA requests
that the City of Little Rock execute an Abandonment of Easements Rights.
NOW, THEREFORE, BE IT RESOLVED BY THE LITTLE ROCK WATER
RECLAMATION COMMISSION, THAT:
The City of Little Rock is hereby requested to approve Costco Wholesale Corporation's
petition for Abandonment of Easement Rights.
2. This Resolution shall be in full force and effect from and after its adoption and approval.

A RESOLUTION RECOMMENDING AND CONSENTING THAT A CERTAIN
SANITARY SEWER EASEMENT IN FAVOR OF THE CITY OF LITTLE ROCK FOR
THE USE AND BENEFIT OF THE LITTLE ROCK WATER RECLAMATION
COMMISSION LOCATED WITHIN THE PROPERTY OF WISTERIA SUBDIVISION,
BE ABANDONED.
WHEREAS, Rausch Coleman Mid -Ark, LLC, an Arkansas corporation, is the current owner of
all lots and tracts in Wisteria Subdivision, in Little Rock, Arkansas; and
WHEREAS, Gladys I. Lambert dedicated a sewer easement across aforementioned property by
Instrument Number 96-53720, filed for record on July 30, 1996; and
WHEREAS, Rausch Coleman has installed new sewer mains on the property to reroute the old
sewer main to facilitate developing the property; and
WHEREAS, Rausch Coleman has dedicated and recorded new sewer easements to cover all
public sewer mains on the property; and
WHEREAS, the full length of the old sewer main is no longer in use and a portion thereof has
been abandoned and removed; and
WHEREAS, Rausch Coleman Mid -Ark, LLC has now requested that the south 498.07 feet of
"Easement No. 3" as described in the right-of-way easement dedicated by Instrument Number 96-53720,
for the old sewer main be abandoned in favor of the new sewer easement; and
WHEREAS, LRWRA agrees that it no longer has need for such easement, LRWRA requests
that the City of Little Rock execute an Abandonment of Easements Rights.
NOW, THEREFORE, BE IT RESOLVED BY THE LITTLE ROCK WATER
RECLAMATION COMMISSION, THAT:
1. The City of Little Rock is hereby requested to approve Rausch Coleman Mid -Ark, LLC's
petition for Abandonment of Easement Rights.
2. This Resolution shall be in full force and effect from and after its adoption and approval.
