Alan,
Attached you will find the portion of the plans that are related to the site. Drawings D000 (Demolition
Site Plan), A000 (Site Plan) and A001 (Site Plan Alternative Option). Please note both A000 and A001 are
both appear to be in compliance with the zoning code with the exception of the additional parking
spaces required for the new restaurant space. The BOA action rectified the parking deficiency. In
addition, since the cost of the renovations do not exceed 50% of the replacement value of the building
no new site or landscape will be required for the interior building remodel.
Let me know if you need anything else.
Thank you,

Thank you. Tracy, can I get copies of the plans submitted for permitting as well? What’s the typical
timeline for approval?
Thanks,
Alan

Jaime,
I think you said that the board of adjustment decision would be complete in a week? If so, can I get a
copy?
Also, has BBB submitted their plans for permitting yet?
Thanks,
Alan

Mr. Bubbus, I'm not sure of staff's procedure but I would start with Mr. Spillman. As the Board of
Adjustment staff I'm sure he can direct you. And the City doesn't transcribe meetings. However,, once
you obtain a copy of the audio/video, you are welcome to hire a court reporter to get a certified
transcription. Yours, Sherri

Thanks again! How do I get a copy of the board of adjustments decision? Also, is it possible for me to
get a transcript of the meeting last night?
Thanks,
Alan

Mr. Bubbus, I am sorry things didn't go your way. I'm sure you can appreciate the fact that it was only
business and nothing personal. Appeals from the Board of Adjustment go to circuit court. I suggest you
contact the Pulaski County Circuit Clerk for instructions on how to file an appeal They use an electronic
filing system and I'm not sure what they do for pro se litigants. While I regret your need for litigation, I
appreciate your position and wish you luck. Be well, Sherri

Sherri,
While I didn’t like the decision last night, I appreciate that you told me where you stood and were
consistent. Can you tell me how to appeal last night’s decision? I’m considering representing myself.
Thanks,
Alan

?Thank you. Please let me know if you have any questions. Part of this litigation involves the use of the
common area and so does this application for 101 S. Bowman. We'd like to request that the city defer
this application until this litigation provides guidance on the use of the common area. This application
for 101 S. Bowman with the city maybe impacted by the courts decision and we'd prefer that the city
not approve a use of the common area that the courts may not allow or involve itself in litigation.
Thanks,
Alan

Thank you. And please let us know if you have any questions, Shawn. I hope that the city can defer this
application until this litigation is resolved rather than be involved in this legal matter.
Thanks,

Dear Mr. Bubbus,
Thank you for sending a copy of the injunction action. I have copied it to this email (instead of leaving it
as merely an attachment to your email) because that way I know that Shawn Overton, the Deputy City
Attorney who basically handles these kinds of matters for the office, will have access to it.
